Low risk waste positions: animals and animal waste

The Environment Agency has provided these LRWPs for waste operations that it considers may be suitable for an exemption.

  1. LRWP 39 has been replaced by regulatory position statement (RPS) 'Storing dead wild animals collected from highways and public areas: RPS 378'.

  2. LRWP 36 was withdrawn on 17 September 2025 as it had been replaced by the regulatory position statement 'Storing and treating animal bedding to make a briquette: RPS 356'.

  3. LRWP 66 on burning bee keeping waste after a disease or infection has been withdrawn and replaced by the regulatory position statement 'Burning or incinerating waste following an animal disease outbreak: RPS 251'.

  4. Withdrawn LRWP 89 as it has been replaced by the regulatory position statement 'Scattering or burying pet ash at a pet cemetery: RPS 310'.

  5. ‘Storing and recovering waste animal bedding from pet retail outlets: LRWP 25' has been withdrawn as there is no information to suggest it is needed.

  6. Removed 'Storing pet cremation ash at a veterinary practice before the owner collects it: LRWP 34' as the pet cremation ash is not considered to be waste as it has not been discarded.

  7. Added 'Scattering or burying ash at a pet cemetery: LRWP 89'.

  8. We have made a minor change to LRWP 39, to clarify that, subject to Animal and Plant Health Agency approval, both domestic dead pets (which are excluded from the Waste Framework Directive) and dead wild animals (which are controlled wastes) can be stored together under LRWP 39 pending disposal. We have changed the wording of the LRWP from referring to dead wild animals only, to dead animals. We have also added a condition to require registration of the storage facility with the Animal and Plant Health Agency under the Animal By-Products Regulations.

If the Environment Agency provides a low risk waste position (LRWP) for an activity, you can carry it out without an environmental permit for a waste operation provided that you meet all the conditions.

The Environment Agency may review its LRWPs. It may decide the activity is no longer suitable for a LRWP or that the conditions need changing. You must regularly check that the LRWP you are benefiting from is still in place.

All the LRWPs for animals and animal waste have now been withdrawn

LRWP 25 on storing and recovering waste animal bedding from pet retail outlets was withdrawn 19 September 2024 as the Environment Agency has no information to suggest it is needed.

LRWP 36 was withdrawn on 16 September 2025 as it has been replaced by the regulatory position statement (RPS) Storing and treating animal bedding to make a briquette: RPS 356.

LRWP 39 was withdrawn on 2 September 2026 as it has been replaced by the regulatory position statement (RPS) Storing dead wild animals collected from highways and public areas: RPS 378.

LRWP 66 on burning bee keeping waste after a disease or infection was withdrawn on 11 September 2025 as it has been replaced by Burning or incinerating waste following an animal disease outbreak: RPS 251.

LRWP 89 was withdrawn on 19 September 2024 as it has been replaced by Scattering or burying pet ash at a pet cemetery: RPS 310.
