This regulatory position statement (RPS) does not change your legal requirement to:
- have an environmental permit where one is required
- comply with the conditions of your environmental permit
- register an activity as exempt where you are required to do so
However, the Environment Agency will not normally take enforcement action if you do not comply with these legal requirements if you meet the requirements in this RPS.
This regulatory position does not apply to any other legal requirements.

The date by which WTEE can be stored under this RPS, and the review date has been extended to 1 April 2027. The conditions for use of the RPS has been updated to include separate requirements for local authorities, along with minimum separation distances for inside and outside storage for all users of the RPS. The RPS now allows operators to use alternative measures where a specific separation distance or sealed drainage measure is not achievable on site where they will provide the same level of environmental protection. The 'Things to note' section has been updated to include a definition of 'Sealed drainage system' and guidance on appropriate use of fire hydrants.
