This regulatory position statement (RPS) does not change your legal requirement to have an environmental permit where one is required.
However, the Environment Agency will not normally take enforcement action if you do not comply with this legal requirement if you meet the requirements in this RPS.
This regulatory position does not apply to any other legal requirements.

Updated this regulatory position statement so it uses the latest template. This RPS is a candidate to become a waste exemption. The next review will be before 1 July 2026.

We have updated this RPS to make it clear that it only applies to local authorities, Highways England and their contractors. We have also extended the review date until 31 January 2023.
