Details

This regulatory position statement (RPS) does not change your legal requirement to:

  • have an environmental permit where one is required
  • comply with the conditions of your environmental permit.

However, the Environment Agency will not normally take enforcement action if you do not comply with these legal requirements if you meet the requirements in this RPS.

This regulatory position does not apply to any other legal requirements.

  1. The Environment Agency are currently in the process of determining and varying several permits for operators who had notified under this RPS. The RPS has been extended until the end of the year to allow them to determine these permit applications and variations.

  2. This RPS has been reviewed and updated to allow operators who notified and received our agreement to operate under RPS 292 during 2024 to continue to use the RPS until their permit or variation has been determined.
