Renters’ Rights Act
As of 1 May 2026, if you are a private landlord of a property in England, there are new and amended grounds for possession within the form that you may use.

You can continue to add grounds for possession under the same rules as before 1 May 2026, if you are a:
- local authority provider of social housing of an assured tenancy in England
- private registered provider of social housing of an assured tenancy in England
- private or social landlord of a property in Wales – make sure you use form for a property located in Wales

If you’re asking for possession of property because of unpaid rent or mortgage (and no other reason), you can use the online service instead.
You must use the N5 form with a ‘particulars of claim’ form. There are different forms for different types of claim:
- Form N119: Give details of a claim for possession of a rented residential property
- Form N120: Particulars of claim (Mortgaged residential premises)
- Form N121: Particulars of claim (Trespassers)
Send your forms to the county court nearest to the property you are claiming possession for.
