Details

The 2015 Deregulation Act received Royal Assent on 26 March 2015. The Act removes, in England, the requirement for permit schemes to be approved by the Secretary of State for Transport and enables local highway or strategic authorities to make, vary or revoke existing schemes using their own orders.

This advice note is aimed at highway authorities that already have a permit scheme, and supports their delivery of the required regulatory amendments to their existing permit scheme by 1 October 2015.

Highway authorities developing new permit schemes should use the existing street works statutory guidance and code of practice to support scheme development. However scheme developers should also use the new advice note to ensure they have captured all the required statutory changes.

Although this advice note provides guidance, it is the responsibility of each highways authority to ensure that it undertakes all required changes to comply with legislation.
