The Retained EU Law (Revocation and Reform) Act has ended the special status of retained EU law, which is now known as ‘assimilated law’ since 1 January 2024, in the UK statute book. This enables assimilated law to be amended, revoked and replaced more easily via legislation such as these statutory instruments.
Negative to sift SIs
Before some Retained EU Law Act SIs are formally ‘laid’ in Parliament, they have to go through a sifting process. A scrutiny committee in the House of Commons and the House of Lords will consider the suitability of the ‘negative procedure’ for these SIs.
