The Data Protection (Fundamental Rights and Freedoms) (Amendment) Regulations 2023

The Statutory Instrument (SI) will amend references to 'fundamental rights and freedoms' in the UK's data protection legislation.

  2. 8 November 2023

     The Data Protection Regulations 2023 were laid in Parliament and the sifting committee has decided that the SI be upgraded to Draft Affirmative. The page has been updated with the new SI and EM documents.

Details

This SI will amend the UK’s data protection legislation by amending ‘fundamental rights and freedoms’ so they refer to rights recognised under UK law, rather than retained EU law rights. 

These retained EU law rights will not be recognised in UK law after the end of December 2023 as a result of changes made by the Retained EU Law (Revocation and Reform) Act 2023.
