Background

This guidance is to be followed by the International Team, where a customer has moved to Universal Credit (UC) and debt has been identified following in year finalisation.

This guidance is to be followed 30 days after the issue date of a UY final Award Notice.

Guidance

Step 1

If you are dealing with a new UY finalised case, go to Step 2.

If you are dealing with case where the Final Award Notice has been re-issued to a change in award due Mandatory Reconsideration, Complaint or Appeal, go to Step 2.

If you are dealing with an expired BF relating to PY debt stability, go to Step 5.

If you are dealing with an expired BF relating to UY debt stability, go to Step 7.

If you are dealing with an expired BF relating to PY and UY debt stability, go to Step 11.

Step 2

Check whether there is a finalised PY claim with the same household makeup. For how to do this, use TCM1000078.

If there is PY claim with the same household makeup, go to Step 3.

If there is not a PY claim with the same household makeup, go to Step 6.

Step 3

Check Household Notes whether debts have been identified for PY and UY. For how to do this, use TCM1000067.

If debt has been identified for the PY claim only, go to Step 4.

If debt has been identified for the UY claim only, go to Step 6.

If debt has been identified for both the UY and PY claim, go to Step 8.

Step 4

Check Household Notes for the message CT01, AR01 or OD02 indicating the customer has submitted a Mandatory Reconsideration, Complaint or Dispute within 30 days of receiving their latest Final Award Notice relating to PY. For how to do this, use TCM1000067 and TCM1000069.

If the customer has submitted a Mandatory Reconsideration, Complaint or Dispute relating to their PY award decision within 30 days of receiving their latest Final Award Notice, go to Step 5.

If the customer has not submitted a Mandatory Reconsideration, Complaint or Dispute within 30 days of receiving their Final Award Notice, go to Step 12.

Step 5

Check Household Notes for any messages indicating that a decision has been made based on the Mandatory Reconsideration, Complaint or Dispute relating to the PY decision. For how to do this, use TCM1000067.

If a decision has yet to be made

  • set a clerical BF of 42 days from the date the Mandatory Reconsideration, Complaint or dispute was received
  • update Household Notes with the message TC12 from TCM0174020. For how to do this, use TCM1000001
  • take no further action.

If a decision has been made that does not change the PY award and 30 days has passed since the issue of the Final Award Notice relating to PY

  • make a note that the PY debt can be considered stable
  • go to Step 12.

If a decision has been made that does not change the PY award and 30 days has not passed since the issue of the Final Award Notice relating to PY

  • set a clerical BF of 30 days from when the Final Award Notice was issued
  • update Household Notes with the message TC13 from TCM0174020. For how to do this, use TCM1000001
  • take no further action.

If a decision has been made that does change the PY award

  • set a clerical BF of 30 days from the date the revised Final Award Notice was issued
  • update Household Notes with the message TC13 from TCM0174020. For how to do this, use TCM1000001
  • take no further action.

Step 6

Check Household Notes for the message CT01, AR01 or OD02 indicating the customer has submitted a Mandatory Reconsideration, Complaint or Dispute within 30 days of receiving their latest Final Award Notice relating to UY. For how to do this, use TCM1000067 and TCM1000069.

If the customer has submitted a Mandatory Reconsideration, Complaint or Dispute relating to their UY award decision within 30 days of receiving their latest Final Award Notice, go to Step 7.

If the customer has not submitted a Mandatory Reconsideration, Complaint or Dispute within 30 days of receiving their Final Award Notice, go to Step 12.

Step 7

Check Household Notes for any messages indicating that a decision has been made based on the Mandatory Reconsideration, Complaint or Dispute relating to the UY decision. For how to do this, use TCM1000067.

If a decision has yet to be made

  • set a clerical BF of 42 days from the date the Mandatory Reconsideration, Complaint or dispute was received
  • update Household Notes with the message TC12 from TCM0174020. For how to do this, use TCM1000001
  • take no further action.

If a decision has been made that does not change the UY award and 30 days has passed since the issue of the Final Award Notice relating to UY

  • make a note that UY debt can be considered stable
  • go to Step 12.

If a decision has been made that does not change the PY award and 30 days has not passed since the issue of the Final Award Notice relating to PY

  • set a clerical BF of 30 days from when the Final Award Notice was issued
  • update Household Notes with the message TC13 from TCM0174020. For how to do this, use TCM1000001
  • take no further action.

If a decision has been made that does change the UY award

  • set a clerical BF of 30 days from the date the revised Final Award Notice was issued
  • update Household Notes with the message TC13 from TCM0174020. For how to do this, use TCM1000001
  • take no further action.

Step 8

Check Household Notes for the message CT01, AR01 or OD02 indicating the customer has submitted a Mandatory Reconsideration, Complaint or Dispute within 30 days of receiving their latest Final Award Notice relating to the PY or UY decision. For how to do this, use TCM1000067 and TCM1000069.

If the customer has submitted a Mandatory Reconsideration, Complaint or Dispute relating only to their PY award decision within 30 days of receiving their latest Final Award Notice, go to Step 9.

If the customer has submitted a Mandatory Reconsideration, Complaint or Dispute relating only to their UY award decision within 30 days of receiving their latest Final Award Notice, go to Step 10.

If the customer has submitted a Mandatory Reconsideration, Complaint or Dispute relating to both their UY and PY award decision within 30 days of receiving their respective latest Final Award Notices, go to Step 11.

If the customer has not submitted a Mandatory Reconsideration, Complaint or Dispute relating to UY or PY within 30 days of receiving their respective Final Award Notice, go to Step 12.

Step 9

Check Household Notes for any messages indicating that a decision has been made based on the PY Mandatory Reconsideration, Complaint or Dispute. For how to do this, use TCM1000067.

If a decision has yet to be made

  • make a note that PY debt is not stable
  • set a clerical BF of 42 days from the date the Mandatory Reconsideration, Complaint or dispute was received
  • update Household Notes with the message TC12 from TCM0174020. For how to do this, use TCM1000001
  • go to Step 12.

If a decision has been made that does not change the PY award and 30 days has passed since the issue of the Final Award Notice relating to PY

  • make a note that PY and UY debt can be considered stable
  • go to Step 12.

If a decision has been made that does not change the PY award and 30 days has not passed since the issue of the Final Award Notice relating to PY

  • set a clerical BF of 30 days from when the Final Award Notice was issued

If a decision has been made that does change the PY award

Step 10

Check Household Notes for any messages indicating that a decision has been made based on the UY Mandatory Reconsideration, Complaint or Dispute. For how to do this, use TCM1000067.

If a decision has yet to be made

  • make a note that UY debt is not stable
  • set a clerical BF of 42 days from the date the Mandatory Reconsideration, Complaint or dispute was received
  • update Household Notes with the message TC12 from TCM0174020. For how to do this, use TCM1000001
  • go to Step 12.

If a decision has been made that does not change the PY award and 30 days has passed since the issue of the Final Award Notice relating to PY

  • make a note that PY and UY debt can be considered stable
  • go to Step 12.

If a decision has been made that does not change the PY award and 30 days has not passed since the issue of the Final Award Notice relating to PY

  • set a clerical BF of 30 days from when the Final Award Notice was issued

If a decision has been made that does change the UY award

  • set a clerical BF of 30 days from the date the revised Final Award Notice was issued

Step 11

Check Household Notes for any messages indicating that a decision has been made based on the PY and UY Mandatory Reconsiderations, Complaints or Disputes. For how to do this, use TCM1000067.

If a decision has yet to be made on either the UY or PY Mandatory Reconsideration, Complaint or Dispute

  • set a clerical BF of 42 days from the date latest unresolved Mandatory Reconsideration, Complaint or dispute was received
  • update Household Notes with the message TC12 from TCM0174020. For how to do this, use TCM1000001
  • take no further action.

If a decision has been made that does not change the UY or PY award and 30 days has passed since the issue of the Final Award Notice relating to UY and PY

Note: you will need to consider the latest issue date of the PY and UY Final Award Notices.

  • make a note that PY and UY debt can be considered stable
  • go to Step 12.

If a decision has been made that does not change the PY or UY award and 30 days has not passed since the issue of the Final Award Notice relating to PY or UY

Note: you will need to consider the latest issue date of the PY and UY Final Award Notices

  • set a clerical BF of 30 days from when the Final Award Notice was issued

If a decision has been made that does change either the UY or PY award

Note: you will need to consider the latest issue date of the PY and UY Final Award Notices.

  • set a clerical BF of 30 days from the date the revised Final Award Notice was issued
  • take no further action.

Step 12

Check whether the debt is still present

If only PY debt is present and stable, go to Step 13.

If only UY debt is present and stable, go to Step 15.

If both PY and UY debt is present and stable, go to Step 17.

If no debt is present, take no further action.

Step 13

Check whether the PY claim for tax credits was a single or joint claim. For how to do this, use TCM1000324.

If the PY claim for tax credits was a single claim

  • complete a form TC33, set the UC interest marker, and include all identified PY debts
  • refer the TC33 to DMB
  • update Household Notes with the message TC14 from TCM0174020. For how to do this, use TCM1000001
  • take no further action.

If the PY claim for tax credits was a joint claim, go to Step 14.

Step 14

Check whether one or both of the applicants have moved to UC. For how to do this, use TCM1000626.

If both applicants have moved to UC

  • complete a form TC33, set the UC interest marker against both applicants, and include all identified PY debts
  • refer the TC33 to DMB.
  • update Household Notes with the message TC14 from TCM0174020. For how to do this, use TCM1000001
  • take no further action.

If one applicant has moved to UC

  • complete a form TC33, set the UC interest marker against the applicant who has moved to UC, and include all identified PY debts
  • refer the TC33 to DMB
  • update Household Notes with the message TC14 from TCM0174020. For how to do this, use TCM1000001
  • take no further action.

Step 15

Check whether the UY claim for tax credits was a single or joint claim. For how to do this, use TCM1000324.

If the UY claim for tax credits was a single claim

  • complete a form TC33, set the UC interest marker, and include all identified UY debts
  • refer the TC33 to DMB
  • update Household Notes with the message TC14 from TCM0174020. For how to do this, use TCM1000001
  • take no further action.

If the UY claim for tax credits was a joint claim, go to Step 16.

Step 16

Check whether one or both of the applicants have moved to UC. For how to do this, use TCM1000626.

If both applicants have moved to UC

  • complete a form TC33, set the UC interest marker against both applicants, and include all identified UY debts.
  • refer the TC33 to DMB
  • update Household Notes with the message TC14 from TCM0174020. For how to do this, use TCM1000001
  • take no further action.

If one applicant has moved to UC

  • complete a form TC33, set the UC interest marker against the applicant who has moved to UC, and include all identified PY and UY debts
  • refer the TC33 to DMB
  • update Household Notes with the message TC14 from TCM0174020. For how to do this, use TCM1000001
  • take no further action.

Step 17

Check whether the PY and UY claims for tax credits was a single or joint claim. For how to do this, use TCM1000324.

If the PY and UY claim for tax credits was a single claim

  • complete a form TC33, set the UC interest marker, and include all identified UY and PY debts
  • refer the TC33 to DMB
  • update Household Notes with the message TC14 from TCM0174020. For how to do this, use TCM1000001
  • take no further action.

If the PY and UY claim for tax credits were joint claims, go to Step 18.

Step 18

Check whether one or both of the applicants have moved to UC. For how to do this, use TCM1000626.

If both applicants have moved to UC

  • complete a form TC33, set the UC interest marker against both applicants, and include all identified PY and UY debts
  • refer the TC33 to DMB
  • update Household Notes with the message TC14 from TCM0174020. For how to do this, use TCM1000001
  • take no further action.

If one applicant has moved to UC

  • complete a form TC33, set the UC interest marker against the applicant who has moved to UC, and include all identified PY and UY debts.
  • refer the TC33 to DMB
