As the result of the Scottish government fully reopening the Forth Road Bridge to all traffic ahead of schedule, this temporary relaxation relating to large goods vehicles has been withdrawn early. It has been superseded by the notification on the Temporary relaxation of the EU drivers’ hours rules: closure of Forth Road Bridge, 18 to 20 February 2016.

The Department for Transport, on request from the Scottish government, applied to the European Commission (EC) for a further extension to the relaxation applicable to goods vehicles weighing over 7.5 tonnes which expired at 23:59 on Monday 15 February 2016.

The department has gained permission from the EC for a temporary and limited relaxation of the enforcement of European Union (EU) drivers’ hours. The relaxation applies to drivers of goods vehicles weighing over 7.5 tonnes involved in the distribution of freight within scope of the regulation, where journeys are delayed or extended due to the partial closure of the Forth Road Bridge in Scotland. The temporary relaxation will begin from 00:01 Thursday 18 February and will run until 23:59 on Thursday 24 March 2016.

This is pursuant to article 14(1) of Regulation (EC) No 561/2006.

The temporary relaxation of the EU drivers’ hours rules reflects the exceptional circumstances of the partial closure of the Forth Road Bridge to large goods vehicles. The department wishes to emphasise that, as a general rule, we expect business to plan for and manage the risks of disruption to supply chains.
