Details

These directions relate to the use by trusts of the powers under section 7(2) and (7A) of the Health and Medicines Act 1988. They require that, in the exercise of those powers by means of forming or participating in companies, they must comply with the conditions set out in the directions.

These directions are currently under review and will be updated in due course.

The directions were originally published as part of the now archived 2002 Department of Health guidance The NHS as an innovative organisation: a framework and guidance on the management of intellectual property in the NHS.

While the guidance has been superseded, the directions are still in force. See the new Intellectual property (IP) guidance for the NHS in England.
