19. Checks on responsible individuals

The responsible individual must meet the requirements of regulation.

The Adoption Support Agencies (England) and Adoption Agencies (Miscellaneous Amendments) Regulations 2005 require adoption support agencies to have a responsible individual.

A provider must demonstrate to Ofsted that the responsible individual they appoint is able to meet the requirements of regulation. Ofsted’s inspectors scrutinise the steps providers have taken to determine that a responsible individual who has been appointed to a registered establishment or agency is fit to supervise its management.

This scrutiny applies in situations where:

  • the identity of a responsible individual changes
  • a person acting as responsible individual becomes responsible for the management of another registered establishment or agency that they did not supervise on 31 March 2014
