Details

The Order was made under the market investigations provisions of the Enterprise Act 2002.

The Competition and Markets Authority’s (CMA) mobile radio network services market investigation identified that Motorola, as monopoly operator of the Airwave Network, is able to charge the Home Office (which negotiates the contracts on behalf of the emergency services) prices well above competitive levels. This Order introduces a price control to tackle the problems identified by the CMA.

The CMA’s final decision was appealed to the Competition Appeal Tribunal by Motorola. On 22 December 2023 the Competition Appeal Tribunal’s judgment upheld the CMA’s decision in the final report. On 30 January 2025 the Court of Appeal dismissed Motorola’s challenge to that judgment.
