Biennial report on reservoir safety: 1 January 2023 to 31 December 2024

1. Executive summary 

This report is a review of reservoir compliance and enforcement of large raised reservoirs (LRRs) in England. It covers the period from 1 January 2023 to 31 December 2024. Over this period the number of registered reservoirs increased from 2,117 to 2,142. 

It includes work done by the Environment Agency’s Reservoir Regulation Team to: 

  • protect the public  
  • ensure compliance with the Reservoir Act 1975 

It also includes data on reservoir registration. 

The reservoir safety industry learnt many lessons from the incident at Toddbrook Reservoir in 2019. The Independent Reservoir Safety Review Report was published in 2020. In response, we established a reservoir safety reform programme. We are working on this in partnership with the Department for Environment, Food and Rural Affairs (Defra), Welsh Government and Natural Resources Wales (NRW).  

The Environment Agency’s ambition is to become a more digitally enabled, confident regulator. We are already adopting this approach in reservoir regulation and have more actions planned for the coming years. Our focus in 2023 and 2024 has been: 

  • finding new solutions to long-standing problems 
  • pro-actively enabling compliance for reservoir owners 
  • working in partnership and being transparent with our processes 
  • doing more with the resources we have  
  • making it easier for organisations to work with us 

This is in line with the Environment Agency’s organisational strategy.  

There have been no significant incidents resulting in loss of life and no total failures of a dam or reservoir in 2023 and 2024.  

Climate change has led to increasing weather extremes. Many reservoirs in England are also aging. This means that our role, regulating reservoir safety, is becoming more and more important. We protect communities from the danger of flooding, which is one of the Secretary of State’s strategic priorities for Defra

2. Background  

Reservoirs in England have a good safety record. The last reservoir failure that led to loss of life in England was more than 100 years ago. Twenty-one people died after the failure of two dams in North Wales in 1925. This tragedy led to the passing of the Reservoir (Safety Provisions) Act 1930. 

Parliament updated and superseded this act with the Reservoirs Act 1975 (the Act). Parliament amended this later act by means of the Flood and Water Management Act 2010.  

Originally, local authorities were responsible for enforcing the Act. The Water Act 2003 transferred this responsibility to the Environment Agency. On 1 April 2013, NRW became the enforcement authority for LRRs in Wales. We (the Environment Agency) remain responsible for LRRs in England.   

Although the safety record in England is good, we cannot be complacent. The risk from reservoirs can be significant if unmanaged. Reservoir operators and owners (undertakers) are responsible for making sure their reservoirs are safe.  

Our role, as the regulator, is to make sure that undertakers follow the legal safety requirements of the Act. We follow the Regulators Code, which means we regulate in a consistent, fair and risk-based way.   

3. Our role 

We track compliance at all LRRs in England. NRW does this in Wales. The Scottish Environmental Protection Agency (SEPA) regulates according to the Reservoirs (Scotland) Act 2011.  

As the regulator, we must:   

  • maintain a register of all reservoirs 
  • make sure that undertakers follow the Act by monitoring compliance and engaging with them 
  • make sure that undertakers appoint a construction engineer. Their role is to supervise the construction, alteration, discontinuance or abandonment of LRRs 
  • make sure that undertakers have emergency on-site flood plans for their reservoirs. These must set out the actions they would take to control flooding in the unlikely event of a reservoir emergency 
  • designate reservoirs as ‘high-risk’ if an uncontrolled release of water from the reservoir could endanger human life 
  • make sure that undertakers appoint a supervising engineer for their high-risk reservoirs 
  • make sure that undertakers have their high-risk reservoirs inspected by inspecting engineers 
  • make sure undertakers carry out any safety measures recommended by inspecting engineers 
  • appoint engineers and commission safety work when an undertaker does not comply with the Act - we charge undertakers for this 
  • appoint engineers and take any other action necessary in an emergency - we charge undertakers for this 
  • make sure that undertakers report reservoir incidents and share lessons learnt from them 
  • make sure that we observe and follow the requirements of the Act for our own reservoirs 

Our role extends beyond monitoring the compliance of LRRs.  

We also:  

  • take enforcement action on undertakers who fail to comply with the Act, when it is appropriate to do so 
  • work with undertakers to provide advice and guidance so they can operate their reservoirs safely 
  • engage with the British Dam Society (BDS) and Institution of Civil Engineers (ICE) to improve knowledge and capability in the industry 
  • advise Defra on operational implications of policy 
  • lead and inform research and development projects to improve knowledge on reservoir safety  
  • work with international partners to share knowledge and lessons learned to improve our own practises 
  • commission and maintain reservoir flood maps for all operational reservoirs - we use these for emergency planning and risk assessment purposes 
  • contribute to legislative reviews and improvements 

The Environment Agency operates 222 of the 2142 reservoirs in England for flood risk and water management purposes. This is done by our operational area-based teams and overseen by 27 different supervising engineers. Sixteen of these 222 reservoirs are under the supervision of an independent construction engineer. These reservoirs are either being built or altered.  

The Reservoir Regulation team is within the Flood and Coastal Risk Management Directorate.  We work in different directorates to ensure our operational and regulatory roles are separate.  

4. Our activities  

4.1 Compliance and Enforcement 

We assign a risk designation of high-risk or not high-risk to each LRR in England. We base it on risk to life in the event of an uncontrolled release of water from the reservoir. We have improved our risk designation process by introducing monthly case reviews. This has allowed us to clear the backlog of designations. We sent 49 final risk designation confirmation letters in 2023 and 2024. We have ensured that we have a resilient and robust risk designation panel to provide greater assurance of the process.   

To enhance reservoir safety and compliance, we implemented compliance action plans in 2024. Compliance action plans are agreements with undertakers focussing on addressing specific safety concerns at their sites. They outline: 

  • important milestones 
  • risk mitigation measures 
  • timelines 

This makes sure that reservoirs are safe during periods of non-compliance. By using this approach, we support undertakers to progress towards compliance. We worked with undertakers to create 6 compliance action plans in 2024.  

We held regular reservoir safety account management meetings with major undertakers. These include: 

  • water companies 
  • Canal and Rivers Trust 
  • the National Trust 
  • Forestry England 
  • Environment Agency

We discussed: 

  • operational challenges 
  • outstanding compliance issues 
  • best practice  

This ensured that reservoirs were maintained to the highest standards of safety.  

We created a risk mitigation matrix to support our risk-based approach and guide our enforcement decisions. We prioritised cases by assessing risks to public safety.  

We collaborated with devolved authorities in 2023 and 2024. This has strengthened our enforcement framework and facilitated the sharing of best practices. Our enforcement framework is the structured approach we use to address non-compliance. It outlines the steps we take for monitoring, identifying and managing non-compliant reservoirs.  

NRW have also adopted compliance action plans. We have worked on enforcement with the Scottish Environmental Protection Agency. We have worked with the Department for Infrastructure in the Northern Ireland Executive, sharing learning and supporting their introduction of reservoir safety practices.  

4.2 Reservoir safety reform 

We have developed the reservoir safety reform programme. This is in response to the recommendations in the Independent Reservoir Safety Review Report. We have an excellent reservoir safety record in England. However, there are reasons to re-evaluate how we regulate reservoir safety. These include the Toddbrook incident in 2019, increasing demands on water supply, and climate change impacts. We have made changes in response to the recommendations in the report.     

In 2023, we created a dedicated page on gov.uk for reservoir safety guidance documents. We have already developed and published new guidance to support engineers and owners.  

Inspecting engineers guidance will ensure that engineers’ reports are: 

  • systematic 
  • detailed 
  • impartial 

Guidance on how to manage your LRR offers simple advice to owners.  

Wales joined the reservoir safety reform programme in 2024. The Welsh Government and NRW are working closely with Defra and the Environment Agency.    

We are considering the options for modernising the reservoir safety legal framework. The preferred approach is bringing regulation into the environmental permitting regime.   

We have looked at different options for the new hazard classification. The preferred approach is a hazard classification with four classes which uses a risk-based approach. We are also working to improve the reservoir safety management system. We are engaging with the industry to gather views to inform and shape the developments.   

In 2023 we ran a voluntary information gathering exercise. This allowed owners of small raised reservoirs to provide us with some basic information about their reservoirs. These are reservoirs with a capacity between 10,000 cubic metres and 25,000 cubic metres. This has helped inform the small raised reservoirs element of the reservoir safety reform programme.  

We have worked with industry when making our changes. We have used surveys, set up advisory groups and presented and ran several workshops at the British Dam Society Conference in 2024. Feedback from these activities will shape the changes we are proposing.   

We are planning a formal public consultation on the reform proposals later in 2025.  

Single reservoir owners 

In September 2024, we conducted a telephone survey, reaching out to all 519 single reservoir owners listed on our database. The aim was to learn more about owners’ and operators’ understanding of reports and their roles and responsibilities. The survey had a high participation rate and provided us with valuable information. 

As a result: 

  • fifty-seven single reservoir owners have now signed up to volunteer for our focus and engagement groups 
  • we held our first webinar with the volunteers in November 2024 
  • we have developed a programme to continue regular engagement to support the reservoir safety reforms  

Review of engineers’ reports and statements 

The Independent Reservoir Safety Review recommended that we should be able to give feedback on the quality and consistency of reports from engineers.  We have strengthened our role and developed an ongoing national assessment of the quality of the reports.  

The reports include:    

  • supervising engineers’ annual statements    
  • inspecting engineers’ reports    

In 2023 and 2024, we reviewed 240 reports and provided guidance and training to engineers. Every supervising engineer and all reservoirs panel engineer has now received a report review.    

This action has led to a significant improvement in the quality of reports over this time.    

We produced new guidance for reservoir inspecting engineers on these reports and statements. This has received support and agreement from all reservoirs panel engineers who carry out these inspections. This guidance aims to improve the clarity and consistency of reports. This makes it easier for reservoir owners to understand the requirements.  

4.3 Research and development  

In 2024 we completed a project providing new guidance on removing or repurposing redundant reservoirs. This was delivered through the Defra and Environment Agency Joint Research Programme. This project sets out the steps to consider when removing or repurposing a reservoir. It covers:  

  • legislation  
  • planning implications  
  • construction  
  • long-term management of the asset

We continue to collaborate with our international partners. We use the experiences from others to enhance our own practices. We can share our successes and lessons learned to keep improving dam safety globally. We have facilitated online knowledge exchange sessions on regulation change and attended meetings to discuss regulation of small raised reservoirs and climate change risks. We shared lessons learned from incidents with the European Dam Safety Authorities Network.  

4.4 Digital innovation 

Section 12 automation project 

In 2024 we worked with the Accelerated Capability Environment, part of the Home Office innovation unit. The project was a proof of concept to find out if artificial intelligence (AI) can tell us if a reservoir is compliant. The intent was to improve our process for reviewing and uploading compliance information. This information comes from Section 12 written statements. We will continue to develop the concept in 2025. 

The aim is to:   

  • improve efficiency by decreasing the working hours spent reviewing and uploading compliance information  
  • improve turnaround times for customers, increasing their satisfaction    
  • improve the overall quality of the data uploaded into our documentation system   
  • quickly identify incomplete reports, ensuring that we only process complete and accurate reports   
  • prepare for the potential increase in statements received 

5. A risk-based approach to enforcement  

The main causes of non-compliance are where an undertaker has not:  

  • appointed a supervising engineer to oversee ongoing safety 
  • appointed an inspecting engineer to carry out the statutory inspection 
  • completed safety measures identified by the inspecting engineer by the date specified in the inspection report 

We continue to focus on reservoirs which pose the greatest risk to public safety. Our main priority is to make sure reservoirs have the correct supervision and that safety works are carried out when required. We make sure that reservoirs always have a construction or supervising engineer appointed. Not having an engineer appointed at the right time poses a significant risk to the safety of that reservoir and communities downstream.  

A construction engineer supervises a reservoir when it is being built or altered. They will issue a final certificate when the work is completed. The undertaker must then appoint a supervising engineer.  

A supervising engineer supervises a high-risk reservoir once it has been built and is in operation. This is a continuous appointment. They visit the reservoir and write an annual statement for the undertaker.  

This statement includes the actions: 

  • the engineer has taken to monitor the reservoir 
  • the undertaker has taken to maintain the reservoir 

The supervising engineer is the most important contact if an issue arises at a reservoir.  

The undertaker must employ an inspecting engineer to carry out a statutory inspection of a high-risk reservoir at least once every 10 years. This is not a continuous appointment.  

The inspecting engineer produces a report and directs the undertaker to carry out any required safety measures. These will have deadlines which the undertaker must meet. The inspecting engineer must certify when safety measures are completed.  

We provide proactive advice and support about complying with the Act when asked. We also provide advice and guidance on how to comply with the Act if a non-compliance offence is committed. We do this in writing or by meeting the undertakers.  

If the offence persists or is serious, we will escalate and take formal enforcement action. When we do this, we follow the Regulators Code. We apply the following principles:  

  • act proportionately 
  • be consistent 
  • be transparent 
  • target enforcement action 
  • be accountable 

5.1 Risk designation 

We assign a risk designation to each LRR in England. The designation level is based on risk to life in the event of an uncontrolled release of water from the reservoir.  

There are 2 designation levels:  

  • high-risk  
  • not high-risk  

High-risk reservoirs must fulfil all the requirements of the Act. There are also some specific elements which ‘not high-risk’ reservoirs must fulfil.  

LRRs which are classed as ‘not high-risk’ do not need a: 

  • supervising engineer appointed 
  • statutory inspection 

Undertakers must still register the not high-risk reservoir, have on-site emergency flood plans and report any incidents. They should inform us if anything changes on site or downstream which might alter the risk designation. These changes could include property developments downstream or alterations to the reservoir.  

We assign a risk designation once we receive a final certificate from a construction engineer.  

There may be reservoirs which do not yet have a risk designation. This can happen where they have been newly constructed or recently altered. If an undertaker has requested a review or appealed a risk designation, a provisional designation will be put in place.

Of the 129 reservoirs under construction:  

  • 78 have a preliminary section 7(1) certificate. This certificate confirms that the reservoir has reached a stage of construction where it can be wholly or partially filled with water 
  • 40 are not yet ready to be filled with water 
  • 11 have preliminary certificates under section 8 or 9 of the Act. Section 8 is used when the undertaker hasn’t appointed a construction engineer. Section 9 is used for reinstating an abandoned reservoir. These reservoirs can also be wholly or partially filled with water 

5.2 Reservoir information

Reservoirs are inspected by an inspecting engineer every 10 years, unless stipulated otherwise by the supervising engineer. The inspecting engineer produces a certificate under Section 10 of the Act.  

In 2023 to2024, 51 % of Section 10 inspection certificates (158 of the 309) contained safety measures. This is a decrease from 56% in 2021-22. The number of inspections taking place and safety measures identified within a two-year window does fluctuate.  

The deadlines to complete measures can be more than one to two years. The 119 section 10(6) certificates showing measures have been completed do not necessarily correspond to the 158 certificates which contained measures to be taken in the interests of safety.

There were 34 newly constructed reservoirs recorded between 1 January 2023 and 31 December 2024. These 34 reservoirs have moved from being under construction to in operation.   

Twenty-five newly constructed reservoirs had a preliminary section 7(1) certificate.

5.3 Compliance figures 

High-risk reservoirs must have a supervising engineer appointed at all times. Reservoir engineers have an important role to provide technical and expert advice to reservoir owners.

The table states where the risk designation for a reservoir is not final. This means that some figures may change in future, as the reservoirs could be determined as not high-risk.  

We have included reservoirs where the inspection has taken place, but we have not yet received the report. The Act allows 6 months for an engineer to finalise their report. This contributes to the higher non-compliance figures because we do not know the date of the inspection until we receive the report. The overdue dates will then be updated.  

We issue a formal notice when an undertaker fails to appoint an inspecting engineer by the inspection due date. Undertakers must then appoint an engineer within 28 days. 

There were 80 reservoirs with outstanding safety measures at the end of 2024. This is an increase from 56 on 1 Jan 2023. Reservoir infrastructure is aging, leading to engineers recommending more safety measures.  

Following the Toddbrook incident in 2019, we have seen an increase in the number of measures in the interests of safety (MIOS) related to spillway safety. We have also seen an increase in MIOS to meet the recommendations in the drawdown capacity guidance published in 2017. There is also a shortage of reservoir engineers, which can delay sign-off of safety measures. The ICE published an independent review of reservoir engineer shortages in 2021. Following this, we are addressing the number, skill level and workload of reservoir engineers through the reservoir safety reform programme. This includes steps to increase training and development of engineers.  

However, we have confidence in the safety of our reservoirs. We have increased our engagement with owners and engineers to pro-actively mitigate the risks associated with pending non-compliances. We assign an enforcement officer to take proportionate, confident action on all reservoirs with outstanding safety measures. We use a range of enforcement actions. This includes advice and guidance, compliance action plans, serving notices and prosecution.  

We are transparent and consistent with how we assess what enforcement action we are taking. 

We expect the number of outstanding MIOS to reduce over the next two years.

5.4 Serving enforcement notices 

We may serve an enforcement notice if an undertaker does not comply after advice and guidance is given.  

We will serve formal notice if an undertaker does not appoint an engineer when required and after reminding. The undertaker must then make the appointment within 28 days. 

If an undertaker does not complete safety measures by a given deadline we can:  

  • ask the undertaker why they have not completed the measures 
  • issue a Compliance Action Plan if appropriate - any safety risk is mitigated and the undertaker is engaged and capable 
  • issue a formal notice for completion of the measures if there is no response 
  • issue a final warning letter if they miss the notice date  
  • prosecute, if the breach is significant and there are no reasonable mitigating circumstances 

We served a total of 81 notices in this reporting period. 19 of these notices (16(1), 17(1), 17(1)(e), 21A) relate to emergency powers, powers of entry and powers to require information, so they may not be directly related to non-compliance. We served notices on 64 non-compliance cases in 2023 and 2024. Of these, 49 cases are now compliant. We continue to monitor and act where necessary on all outstanding cases.

The number of outstanding safety measures in Table 6 is higher than the number of notices served in Table 7. This is because overdue measures do not always need a notice to encourage an undertaker to comply. Often, the non-compliance can be addressed following tailored advice and guidance.

5.5 Other enforcement action  

We may issue a written warning if an undertaker remains non-compliant after the notice deadline. We issued two of these warnings between January 2023 and December 2024.  

We are currently investigating 108 reservoirs and may take enforcement action depending on the results. 

We apply a risk-based approach to achieve the right outcome for safety. This means we have used our professional judgement. We may consult with panel engineers and lawyers to take appropriate action. That action could be to issue advice and guidance or could go as far as carrying out emergency works. We carried out emergency works at 1 reservoir between January 2023 and December 2024. 

We take this approach so that we can achieve safe outcomes in line with the Regulators Code. It is not always appropriate for us to take punitive enforcement action if a reservoir becomes non-compliant. 

We have continued to monitor and collect data on:  

  • offences under section 11(2) – keeping and updating the prescribed form of record 

  • offences under section 10(5A) – maintenance measures 

We have been collecting this data, however due to its complexity, we will not be including this information in the current report. 

We will continue to monitor this data and review the benefit of reporting on this in the next report. 

We encourage engineers to highlight any specific concerns about section 11 or 10(5A) non-compliances to us. 

5.6 Environment Agency Reservoirs 

We are the undertaker for 222 LRRs in England.  

There were 6 cases of non-compliance at our reservoirs in 2023 and 2024. Three reservoirs remain non-compliant, including Warnham Mill Pond Reservoir. The Environment Agency is one of three joint undertakers for Warnham Mill Pond Reservoir. The Environment Agency undertaker has met their obligations for the areas that are within our responsibility. 

5.7 Incident reporting  

Incident reporting became mandatory in 2013. Undertakers must report any reportable incidents which happen at their reservoir. A reportable incident is “an incident which results, or could result, in the uncontrolled release of water from an large raised reservoir.”  

This also includes where “measures have been taken to prevent any or any further uncontrolled release of water and to minimise the danger to human life”.  

We use this information to improve safety by:  

  • investigating incidents where appropriate 

  • informing the industry of any trends and important lessons identified  

  • contributing to research into reservoir safety and incident analysis 

We publish detailed information in our annual post incident report. This means those involved in reservoir safety can learn from past incidents.  

Reporting is only mandatory for incidents at LRRs. We encourage undertakers to report incidents at small raised reservoirs on a voluntary basis.

We expect the number of incident reports to increase in the future. This is not necessarily because more incidents are happening, but that we expect to receive more as the reporting culture improves. We are working to raise awareness of the benefits that incident reporting brings.  

We continue to encourage undertakers to report all incidents, and near misses. We have not taken enforcement action to obtain incident reports, but we have issued reminders to undertakers where a report is due. Compliance with the regulations on incident reporting is generally seen to be good and improving. 

Some of these figures may have been different in previous reports. It is likely that this is due to discrepancies with what has been classed as an incident or near miss during the different time periods. The figures in table 9 are correct up to 2022, however 2023 and 2024 figures may change. This is because reservoir undertakers have 12 months after an incident to provide us with a full post-incident report. 

6. The future 

We will continue to explore digital innovation to improve ways of working. We will create efficiencies and improve data quality and consistency. This includes working with specialised digital teams to adopt these new technologies. We hope to use artificial intelligence to improve how we work and the experiences of our users.  

We would like to improve our transparency and collaboration with the industry. We will communicate and engage more with undertakers, engineers and professional institution partners.  

We will continue to take firm action against those whose performance puts public safety at risk. We will ensure that regulation translates into compliance and that serious non-compliance is held to account. 

Climate change is an important topic, posing a significant risk to the reservoir industry. In 2025, we will be reviewing and updating our research strategy. We will evaluate how we can better support the industry’s research needs considering climate change, and other emerging threats. We will continue to deliver research through the Defra and Environment Agency joint programme.  

We will maintain our work on our reservoir reform programme and provide regular updates.

7. Appendix 1: Reservoir data and statistics 

This report has previously shown reservoir data from 2005 to present. We have changed the tables to show only the past 10 years of data and information. If you are interested in data from before 2015, you can access this in the 2021 to 2022 report.  

7.1 Dam category 

Although not legally required, a reservoir construction or inspecting engineer should assign a dam category to an impounding LRR as best practice. The category the engineer assigns depends on potential consequences of a dam breach. The dam category assigned is based on ICE guidance for reservoir flood spillway design and takes a risk-based approach to reservoir design and inspections.

In table 10, a: 

  • category A dam is where a breach could endanger lives in a community 
  • category B dam is where a breach could endanger lives not in a community or could result in extensive damage 
  • category C dam is where a breach would pose negligible risk to life and cause limited damage 
  • category D dam - special cases where no loss of life can be foreseen as a result of a breach and very limited additional flood damage would be caused 
  • ‘not assigned’ case is where in some cases, engineers have not assigned a dam category yet- majority of these are non-impounding and service reservoirs 

Before July 2013 engineers did not need to submit to us copies of section 10 reports that did not contain safety measures. The ‘not known’ category refers to where dam categories may not be available for some reservoirs. This category also includes reservoirs under construction where the dam category is yet to be determined. This number is reducing as we receive new reports.

All high-risk reservoirs must be inspected periodically by an inspecting engineer, at intervals no greater than 10 years. On 31 December 2024 there were 71 reservoirs with an overdue section 10 inspection. Of these: 

  • 61 had an overdue S10 inspection report, but they had appointed an inspecting engineer. This means that a report and inspection was underway. 51 of these had been overdue for under a year and 10 had been overdue for at least a year 
  • 10 had an S10 inspection overdue and they had not appointed an inspecting engineer. 2 of these had been overdue for under a year and 8 had been overdue for at least a year 
  • the figures may include reservoirs awaiting a risk designation

MIOS are essential works identified by an inspecting engineer during part of a section 10 inspection. The undertaker is legally required to implement MIOS

Reservoirs with MIOS are not necessarily non-compliant. 253 is the total number of reservoirs that had safety measures identified at the end of 2024. Only 80 of these have safety measures that are overdue beyond their target date.  

There has been an increase in the number of outstanding safety measures from 36 on 2 Jan 2015 to 80 at the end of 2024. Reservoir infrastructure is aging, leading to engineers recommending more safety measures. Following the Toddbrook incident in 2019, we have seen an increase in the number of MIOS related to spillway safety. We have also seen an increase in MIOS to meet the recommendations in the drawdown capacity guidance published in 2017. The ICE published an independent review of the supply and capacity of reservoir safety panel engineers in 2021. Following this, we are addressing the number, skill level and workload of reservoir engineers through the reservoir safety reform programme. This includes steps to increase training and development of engineers.  

We have previously reported on MIOS without a target date. It is no longer possible to have MIOS without a target date. The number of LRRs with MIOS for which there is no target date will continue to be 0 from now on.

8. Appendix 2: Steps taken by the enforcement authority to ensure that undertakers observe and comply with the requirements of the act 

The Environment Agency refers to sections of the Act in appendix 2. The notices listed refer to:  

  • section 8(1) ‘Powers of enforcement authority in event of non-compliance with requirements as to construction or enlargement of reservoirs’ – the offence is failure to appoint a construction engineer 

  • section 10(7)(a) ‘Periodical inspection of large raised reservoirs’ – the offence is failure to appoint an inspecting engineer 

  • section 10(7)(b) ‘Periodical inspection of large raised reservoirs’ – the offence is that the latest Section 10 report contains safety recommendations and a date by which these must be done and the work has not been done as required or by the date required
