1. Notice of withdrawal of recognition

The Office of Qualifications and Examinations Regulation (Ofqual) has determined that London Centre of Marketing Limited, trading as London Centre of Marketing (‘LCM’):

  • has failed to comply with the General Conditions of Recognition (‘the Conditions’) to which its recognition is subject, has been given Notice of Ofqual’s intention to Withdraw its Recognition and has been given the opportunity to make representations, and
  • in accordance with its powers under s152 (2)(b) of Apprenticeships, Skills, Children and Learning Act, 2009 (‘the 2009 Act’),
  • its recognition should be withdrawn in respect of all qualifications or descriptions of qualifications for which LCM is recognised.

Ofqual gives notice that:

  1. Ofqual intends to Withdraw Recognition from LCM in respect of the award or authentication of every qualification or description of qualification in respect of which LCM is recognised on Wednesday 22 January 2014, effective from 01:00

    Ofqual may decide to defer this date in the event that LCM seeks an Independent Review of Ofqual’s decision to Withdraw Recognition.
  2. The grounds and reasons on which Ofqual has based its decision to Withdraw Recognition are set out in the ‘Reasons’ document labelled Appendix 1 attached.

    A Schedule of identified breaches is set out at Appendix 2.

  3. Subject to any representations you wish to make regarding the factual accuracy of matters contained in the Notice and Reasons, Ofqual intends to publish the Notice of Withdrawal of Recognition on or after 3 January 2014 and will notify each of LCM’s approved centres that it has determined to Withdraw Recognition.

    If you wish to make any representations concerning factual accuracy only you must notify Ofqual in writing to: enforcementcommittee@ofqual.gov.uk setting out the issue you consider is incorrect and your reasons for considering this together with any documents or evidence you wish to rely on.
  4. Representations on publication must be received by 17:00 on Thursday 2 January 2014.

    You may seek an Independent Review of Ofqual’s decision to Withdraw your Recognition.

    If you wish to seek an Independent Review you must notify us in writing to: enforcementccommittee@ofqual.gov.uk within 30 days of the date of this Notice, before 17:00 on Monday 20 January 2014.

    Any request for an Independent Review must set out the reasons why you consider the process used to consider the decision to Withdraw your Recognition was unfair, or the decision was not reasonable, taking into account all the evidence available.

    New evidence is not normally accepted unless it was not reasonably available at the time the decision was made.
  5. Ofqual has decided not to make saving or transitional provisions for Learners in this case.

  1. If you choose not to make comments on the factual accuracy of the Notice and Reasons these will be published.
  2. Ofqual has appointed a person to act as its Independent Reviewer who has no previous involvement with Ofqual. Any Independent Review, where requested will normally take no more than 60 days. There is no further right of appeal to Ofqual following the determination of the Independent Review.
  3. Service of a Notice of Withdrawal of Recognition does not affect your obligation to comply with the General Conditions of Recognition, any Regulatory Action currently in force, and other relevant regulatory documents.
