Fair Work Agency inspections and investigations of labour users

A Fair Work Agency (FWA) inspector may inspect and investigate labour users that use a labour provider to supply workers for:  

  • agriculture   

  • horticulture   

  • shellfish gathering   

  • food processing and packaging

Inspections 

When a licensed labour provider starts trading, FWA will inspect them. This inspection may take place in person or virtually. 

If you have a contract with the labour provider, FWA may include you in the inspection. 

The inspector will interview some of the workers supplied by the labour provider. They may also visit some workers in their homes. 

Investigations 

FWA will investigate labour users who use unlicensed labour providers. This could lead to prosecution or other sanctions.  

FWA will also investigate if a labour user reports that they are using, or have used, an unlicensed labour provider.
