These undertakings were made under the market investigation provisions of the Enterprise Act 2002.
The signatories must:
- hold no more than 12 gas tariff pages each
- provide information to the Gas and Electricity Markets Authority (GEMA) so it can monitor gas tariff codes allocation
- follow directions from GEMA to transfer their gas tariff pages to other suppliers
Further information is available on the energy market investigation case page.
24 April 2018: Following consultation with GEMA, the CMA confirms that a modification to the Supply Point Administration Agreement that achieves the aim of the provisions set out in the Undertakings has been implemented, and therefore the CMA has released the six energy companies listed in the undertakings and their Affiliated Licensees, from Articles 3 to 7 of the Undertakings.
As the condition set out in Article 9.4 of the Undertakings has not yet been satisfied, all other provisions of the Undertakings remain in force.
