Decision

On findings under Section 26 (1) (e), (f) and (h) of the Act,

And, subject to the operator’s acceptance of the following statement of intent that both Ramneet Oberoi and Ishleen Oberoi will stand down as directors of the company to be replaced by Sahab Oberoi by 31 December 2021 at the latest,

The operator company’s fitness remains intact.

This operator’s licence is curtailed from 3 vehicles and 3 trailers to 2 vehicles and 3 trailers indefinitely. This order takes effect from 23.45 hours 5 November 2021.

The vehicle to be removed from the operator’s licence to be notified to this office before the curtailment comes into operation.

A formal warning is recorded.

Undertakings to be agreed will be attached to the licence, as follows:

  • Vehicles and trailers operated under the licence will be subject to preventive maintenance inspections at least every 6 weeks. Records of such inspections will be retained for 2 years;

  • The operator will make arrangements for laden brake testing by means of a rolling road brake test that will be carried out for all vehicles and trailers at every other maintenance inspection with records kept for 2 years. Intervening brake tests will be the use of a means giving a measured outcome.

  • If for any reason, before June 2022, the operator shall cease the contractual arrangement that it has in place with Caleb Moore to provide for his transport systems advice including attendance twice per month, both he and the operator will notify me as soon as this happens.
