The Traffic Commissioner for North West England decided:

on findings pursuant to Section 14ZA(2) and Section 17(1)(a) of the Public Passenger Vehicles Act 1981, I find that Hobans 1923 Ltd no longer satisfies the requirement of financial standing.

I grant a period of grace for financial standing to be shown until 30 September 2023.

no further action is taken against Hobans 1923 Ltd in relation to the wheel loss incident on 4 January 2023 and the subsequent DVSA investigation visit on 11 January 2023.

no further action is taken against Transport Manager Alison Burgess. Her good repute and professional competence are untarnished.

the following undertakings offered by Hobans 1923 Ltd shall be recorded on the licence PC2011998.
- the operator will provide original or copies (verified by the issuing bank or building society) of financial evidence in the name of Hobans 1923 Ltd covering the period 1 June 2023 to 31 August 2023 to the Office of the Traffic Commissioner at Golborne by no later than 15 September 2023. This must show that the operator has continued to meet the required level of available finance throughout the period by reference to an average balance, dependant on the rates applicable at that time. Rates to be found in the Senior Traffic Commissioner’s Statutory Document No. 2 [https://www.gov.uk/government/publications/traffic-commissioners-finance-march-2019](https://www.gov.uk/government/publications/traffic-commissioners-finance-march-2019%20) Where originals are not available each statement must be stamped and authenticated by the bank/building society.
- Hobans 1923 Ltd will prove a copy of the audit report it has commissioned for June 2023 together with the operator’s detailed proposals for implementing the report’s recommendations, to the Office of the Traffic Commissioner at Golborne within 14 days of the date the operator receives it from the auditor and by no later than 31 August 2023.
