The Traffic Commissioner for Wales decided:

Decisions made in respect of Carmarthenshire Recycling & Environmental Services Ltd OG0095220

  • adverse findings are made in terms of sections 26(1)(c)(iii), 26(1)(e) and 26(1)(f) of the Act. The licence is curtailed under section 26(1) by seven vehicles (i.e. authorisation is reduced from 17 vehicles to 10 vehicles) for a period of 2 months with effect from 23:45 hours on 26 July 2023 until 23:45 hours on 26 September 2023.

  • the following undertaking, agreed to by the licence holder, is attached to the licence:

the operator will arrange an independent audit to be carried out by the RHA, Logistics UK, or other suitable independent body (but not NRT consultancy due to their current involvement) by 24 January 2024. The audit will assess the systems for complying with maintenance and the effectiveness with which those systems are implemented. A copy of the audit report, together with the operator’s detailed proposals for implementing the report’s recommendations, must be sent by email to the Office of the Traffic Commissioner at cymru.wales@otc.gov.uk by 7 February 2024.

  • The licence holder’s repute is severely tarnished, but not lost.
