The Traffic Commissioner for North West England decided:

CAD - POULTRY LTD OC2036894

On findings in accordance with Sections 26(1)(b), 26 (1)(c)iii), 26(1)(e), 26(1)(f) and 27(1) of the Goods Vehicles (Licensing of Operators) Act 1995, the standard national goods vehicle licence of CAD – Poultry Ltd OC2036894 is revoked with effect from Friday 28 April 2023.

I record a formal strong warning against Transport Manager Mohammad Yassir Nassib. His good repute is marked as tarnished but not lost.

360 TRANSPORT LTD OC2060797

On findings pursuant to Section 13A, 13B, 13C and 13D and Section 24 of the Goods Vehicle (Licensing of Operators) Act 1995, The application for a standard international goods vehicle operator’s licence by 360 Transport Ltd OC2060797 authorising the use of 4 vehicles and 10 trailers is granted on an interim basis with immediate effect for a term ending on 30 September 2023 and subject to the conditions recorded below. The interim direction will expire on 30 September 2023 without further notice unless a final determination on the application has been made or the Traffic Commissioner has directed an extension of the expiry date.

A formal warning is recorded.

The following conditions shall be recorded on the interim licence:

i. 360 Transport Ltd will provide original or copies (verified by the issuing bank or building society) of financial evidence in the name of 360 Transport Ltd covering the period 17 May 2023 to 17 August 2023 to the Office of the Traffic Commissioner at Golborne by no later than 31 August 2023. This must show that the operator has continued to meet the required level of available finance throughout the period by reference to an average balance, dependent on the rates applicable at that time. Rates to be found in the Senior Traffic Commissioner’s Statutory Document No. 2 https://www.gov.uk/government/publications/traffic-commissioners-finance-march-2019 Where originals are not available each statement must be stamped and authenticated by the bank/building society.

ii. The operator will arrange an independent audit to be carried out by the RHA, Logistics UK or other suitable independent body in July 2023. The audit will assess the systems for complying with maintenance and drivers’ hours requirements, and the effectiveness with which those systems are implemented. The audit should cover at least the applicable elements in the attached annex. A copy of the audit report, together with the operator’s detailed proposals for implementing the report’s recommendations, must be sent to the Office of the Traffic Commissioner at Golborne within 14 days of the date the operator receives it from the auditor and by no later than 31 August 2023.

iii. By 31 May 2022 Mohammad Yassir Nassib will either:

  • attend in person a two-day transport manager CPC refresher course; or
  • participate in a virtual online two-day transport manager CPC refresher course.

Courses must be run by a trade association (Logistics UK/RHA/BAR/CPT), a professional body (IoTA/CILT/SOE/IRTE) or an exam centre approved by an accredited body to offer the transport manager CPC qualification in goods transport.

Virtual online courses must satisfy the criteria for such courses established by the traffic commissioners.
