Legislation behind ESOS
The government originally established ESOS to implement Article 8 (4-6) of the EU Energy Efficiency Directive 2012/27/EU.
ESOS came into force in July 2014 under the Energy Savings Opportunity Scheme Regulations 2014 – referred to in this guidance as ‘the ESOS Regulations’.
ESOS is an energy assessment and energy saving scheme established by the Energy Savings Opportunity Scheme Regulations 2014 (ESOS Regulations), most recently amended by the Energy Savings Opportunity Scheme (Amendment) Regulations 2026.
Following the UK’s exit from the EU, replacement primary powers were established in the Energy Act 2023.
Companies Act 2006: UK Act to set out the legal operation of companies.
Employment Act (Northern Ireland) 2016: An Act to set out employment and employment relations rules in Northern Ireland.
Insolvent Act 1986: UK Act to consolidate enactments relating to company insolvency, winding up, and insolvency and bankruptcy of individuals.
BSI Standards
PAS 51215 Energy efficiency assessment: competency of a lead PAS energy assessor specification
This standard sets out the requirements for Lead Assessors to ensure Professional Bodies only include competent Lead Assessors in the Approved Registers.
This is relevant for participants who must comply with ESOS requirements, as well as the lead assessors undertaking the ESOS energy audit which may include energy consultants.
This standard has been withdrawn but remains the current standard for Lead Assessors.
PAS 51215-1:2025 Energy and decarbonisation assessment process specification
This is currently a voluntary standard although recognised as good practice to adopt at this early stage. The standard outlines how to combine an assessment to identify and evaluate the costs and benefits for organisations to decarbonise and to meet net zero.
PAS 51215-2:2025 Energy and decarbonisation assessment, competencies of lead assessors and assessment teams, specification
This is currently a voluntary standard although recognised as good practice to adopt at this early stage. This standard confirms the competencies necessary for assessing an organisations energy use and greenhouse gas emissions.
