Notice by the Secretary of State under section 52 of the National Parks and Access to the Countryside Act 1949: Weybourne to Hunstanton

Introduction
On 21 March 2018, Natural England submitted a compendium of coastal access reports relating to the stretch of coast from Weybourne to Hunstanton to the Secretary of State for Environment, Food and Rural Affairs under section 51 of the National Parks and Access to the Countryside Act 1949 (“the 1949 Act”), pursuant to its duty under section 296(1) of the Marine and Coastal Access Act 2009 (“the 2009 Act”).
This determination relates to lengths WBH1-6, which covers the entire stretch.
In reaching a determination under section 52 of the 1949 Act the Secretary of State has considered:
a. Weybourne to Hunstanton reports WBH1-6 – part of Natural England’s coastal access report compendium for the Isle of Wight submitted to the Secretary of State on 21 March 2018
b. in accordance with paragraph 16(1)(a) of the Schedule, the objections which the appointed person determined to be an admissible objection
c. in accordance with paragraph 16(1)(b) of the Schedule, Natural England’s comments on the admissible objections which it sent to the Secretary of State
d. in accordance with paragraph 16(1)(c) of the Schedule, the reports given to the Secretary of State by the appointed person in respect of the objections which the appointed person determined to be an admissible objection
e. in accordance with paragraph 16(1)(d) of the Schedule, representations made by a person within paragraph 2(2)(b) to (f) of the Schedule and the summary of other representations made, and Natural England’s comments on those representations which it sent to the Secretary of State in June 2020
f. Section 245 of the Levelling Up and Regeneration Act 2023 imposes a duty upon the Secretary of State, when exercising any function which has any effect upon land in a an Area of Outstanding Natural Beauty to seek to the further the purposes of those areas. In this case the creation of coastal access in and around these Areas of Outstanding Natural Beauty may have an effect upon them. However, in making this decision the Secretary of State has sought to further the purpose of the conservation and enhancement of these Area of Outstanding Natural Beauty by satisfying itself that no harm will come to these areas as a result of the creation of the new coastal access.
In this notice –
(a) “objection” means an objection about the coastal access report which is made under paragraph 3 of Schedule 20 of the Marine and Coastal Access Act 2009; and
(b) “representation” means a representation about the coastal access report which is made under paragraph 7 of Schedule 20 of the Marine and Coastal Access Act 2009.
Secretary of State’s approval of coastal access proposals
The Secretary of State has determined to approve those proposals for the route and associated coastal margin as set out in length reports WBH1 to WBH6 with slight modifications.
In the respects specified in the objection set out at Annex A to this notice, the Secretary of State determines that the proposals set out in the coastal access report do not fail to strike a “fair balance” as a result of the matters specified in the objections. The Secretary of State therefore approves the proposals set out in the coastal access report so far as they relate to those parts of the route (and associated coastal margin) to which the objection relates.
Where proposals are approved in full, the additional conclusions and observations of the Secretary of State in relation to the representations are set out at Annex B to this notice.

Annex A: Objections which did not fail to strike a “fair balance”

The land in the Report to which the objection relates is route sections WBH-2-S009 to WBH-2-S010. The Secretary of State notes the consideration and recommendation of the appointed person in regard to this objection and agrees with the inspector’s conclusion that the proposed sections of the King Charles III England Coast Path are unlikely to cause significant negative impacts concerning the issues raised around private land use and the necessity of the route. These concerns can be mitigated through the adjustment of the route if land use changes in the future. Also, the proposed route remains in good condition and is frequently used by the public, providing a more accessible and practical option than the alternative proposal to move the trail to a flood defence bank. Consequently, the Secretary of State approves the proposals in relation to this route section.

The land in the Report to which the objection relates is route sections WBH-2-S043 RD and WBH-2-S059. The Secretary of State notes that the objector raised concerns about the proposed exclusion of coastal access rights over this section of saltmarsh. The Secretary of State acknowledges that Natural England has since withdrawn the proposed section 25A and section 26(3)(a) exclusions. Instead, informal management measures such as bespoke signage at access points to the saltmarsh will be introduced to warn people of the potential risks when accessing the area. Consequently, the Secretary of State approves the proposals in relation to this route section with this modification in place.

The land in the Report to which the objection relates is route sections WBH-3-S009 to WBH-3-S010, WBH-3-S004 to WBH-3-S006, and WBH-3-S003. The Secretary of State notes that the objector raised concerns regarding the inclusion of certain areas in the landward spreading room, the proposed exclusions of coastal access rights over saltmarsh and mudflats, as well as issues related to safety and the protection of wildlife. The Secretary of State acknowledges that Natural England has since withdrawn the proposed section 25A (saltmarsh and flats unsuitable for public access) and section 26(3)(a) exclusions for these saltmarsh and mudflat areas. Instead, informal management measures such as bespoke signage at access points to the saltmarsh will be introduced to warn people of the potential risks when accessing the area. The Secretary of State also notes that NE has agreed to adjust the landward boundary between WBH-3-S004 and WBH-3-S006 to ensure consistency with other sections of the trail and has proposed realigning the trail near WBH-3-S003, relocating it away from the Beach Road car park. Furthermore, a year-round dog restriction will be introduced to safeguard sensitive areas. Consequently, the Secretary of State approves the proposals in relation to this route section with these modifications in place.

The land in the Report to which the objection relates is route section WBH-4-S015 FP. The Secretary of State notes that the objector raised concerns about the ambiguity of the landward boundary description. The Secretary of State acknowledges that Natural England has responded to these concerns by proposing a modification to clarify the boundary description, thus ensuring greater clarity for both landowners and walkers. Additionally, the surface description will also be updated to reflect conditions on the ground. Consequently, the Secretary of State approves the proposals in relation to this route section with these modifications in place.

The land in the Report to which the objection relates is route section WBH-4-S015 FP. The Secretary of State notes that the objector raised concerns about the ambiguity of the landward boundary description. The Secretary of State acknowledges that Natural England has responded to these concerns by proposing a modification to clarify the boundary description, thus ensuring greater clarity for both landowners and walkers. Additionally, the surface description will also be updated to reflect conditions on the ground. Consequently, the Secretary of State approves the proposals in relation to this route section with these modifications in place.
Objection Reference: MCA/Weybourne to Hunstanton/O/18/WBH0879
The land in the Report to which the objection relates is route section WBH-4-S024. The Secretary of State notes the consideration and recommendation of the appointed person in regard to this objection and agrees with the inspector’s conclusion that the proposed sections of the King Charles III England Coast Path are unlikely to cause significant negative impacts concerning the issues raised around encroachment on private land and commons rights. These concerns are addressed following confirmation that the route avoids private land, and that the coastal access rights over saltmarsh areas do not impact the objector’s common rights. Consequently, the Secretary of State approves the proposals in relation to this route section.
Objection Reference: MCA/Weybourne to Hunstanton/O/75/WBH1144
The land in the Report to which the objection relates is route sections WBH-5-S014RD to WBH-5-S018RD. The Secretary of State notes the consideration and recommendation of the appointed person in regard to this objection and agrees with the inspector’s conclusion that the proposed sections of the King Charles III England Coast Path are unlikely to cause significant negative impacts concerning the issues raised around safety and future land use. These concerns can be mitigated through the use of additional signage to alert drivers to walkers. Also, the trail’s alignment at WBH-5-S016 has been adjusted to minimise land impact, with a narrower width of 1.2 meters, and there are no restrictions preventing future development or land use changes. Consequently, the Secretary of State approves the proposals in relation to this route section with these modifications in place.

The land in the Report to which the objection relates is route section WBH-5-S019. The Secretary of State notes the consideration and recommendation of the appointed person in regard to this objection and agrees with the inspector’s conclusion that the proposed sections of the King Charles III England Coast Path are unlikely to cause significant negative impacts concerning the issues raised around land take, potential loss of agricultural income, crop contamination, and safety risks associated with farming operations. These concerns can be mitigated through the reduction in trail width to 1.2 metres and the use of signage to promote responsible dog ownership. Consequently, the Secretary of State approves the proposals in relation to this route section with these modifications in place.

The land in the Report to which the objection relates is route section WBH-5-S019. The Secretary of State notes the consideration and recommendation of the appointed person in regard to this objection and agrees with the inspector’s conclusion that the proposed sections of the King Charles III England Coast Path are unlikely to cause significant negative impacts concerning the issues raised around land take, potential loss of agricultural income, crop contamination, and safety risks associated with farming operations. The objector also suggested aligning the trail along the existing Norfolk Coast Path National Trail (NCPNT). The concerns raised can be mitigated through the reduction in trail width to 1.2 metres and the use of signage to promote responsible dog ownership. Also, aligning the trail along the existing NCPNT is inconvenient due to increased road walking and the proposed path adheres more closely to the coastline. Consequently, the Secretary of State approves the proposals in relation to this route section with these modifications in place.

The land in the Report to which the objection relates is route section WBH-6-S002 FP. The Secretary of State notes that the objector raised concerns about the width of the proposed coastal margin and made the case for it to be realigned to reflect a repositioned fence. The Secretary of State acknowledges that Natural England has agreed to amend the landward boundary of the coastal margin to align with the new fence line. Consequently, the Secretary of State approves the proposals in relation to this route section with this modification in place.

Secretary of State’s conclusion and observation:
The Secretary of State notes the Ramblers’ concerns regarding the obstruction of a footpath at Cley-Next-the-Sea and the current route following the A149, which is unsafe and unpleasant for walkers. However, the Secretary of State notes that the Environment Agency has installed a 220-meter boardwalk between sections WBH-1-S016 to WBH-1-S022, which provides a more scenic route to the sea, and Natural England is happy to update the proposed route to incorporate this boardwalk. The Secretary of State agrees with Natural England’s proposal to modify the route while maintaining the original route when the boardwalk is inaccessible due to high tide.

The Secretary of State notes the Ramblers’ concerns regarding the potential challenges of roll-back along the shingle route, their suggestion for an inland route to be formally designated, and the modification of steps to slopes to widen access on part of the route WBH-1-S013. However, the Secretary of State supports Natural England’s position that normal roll-back is anticipated along this section and formal alternative routes can only be proposed where regular flooding or tidal issues affect the route, which is not the case here. Also, alternative routes can still be implemented if needed. Finally, the Secretary of State notes that the modification of steps to slopes at WBH-1-S013 could not be carried out due to the constraints of the location and proximity to the sea wall.
