The Secretary of State for Health and Social Care has a power under Section 1 (3) of the Abortion Act 1967, as amended, to approve places for the purpose of treatment for termination of pregnancy (abortion).
All places operated by non-NHS bodies must be approved.
The Secretary of State will consider the approval of places for the purposes of section 1(3) of the Abortion Act 1967 if proprietors undertake to comply with:
- the Abortion Act 1967 and regulations made under the act - Abortion Regulations 1991
- the Health and Social Care Act 2008 (Regulated Activities) Regulations 2014
- the Care Quality Commission (Registration) Regulations 2009
- the Health and Care Act 2022
- the Department of Health and Social Care’s required standard operating procedures (RSOPs) published in 2020, incorporating new guidance relating to the legal requirements of the Abortion Act
Approval is granted on the basis of a provider’s declaration to comply with and maintain the standards required by the Secretary of State for Health and Social Care in the RSOPs and confirmation that monitoring arrangements are in place to ensure that these requirements are met.
Failure to comply with these requirements and associated regulations and/or the RSOPs may lead to the withdrawal of Secretary of State’s approval.
All current approvals are now valid until 31 July 2026.

- ‘BPAS’ stands for British Pregnancy Advisory Service
- ‘NUPAS’ stands for National Unplanned Pregnancy Advisory Service
