The Debt Respite Scheme (Breathing Space) gives someone in problem debt the right to legal protections from their creditors.

If you have a debt that you think is eligible for a breathing space, you should get advice from a debt adviser.

If having your address shared with a creditor will put you or others at risk of harm, you can ask your debt adviser to not share it.

If your debt adviser decides your address can be shared, you can appeal to the court with this form within 28 days of the decision.

The breathing space will not start until your appeal has been considered by the court.

How to appeal

Complete the form and send it your local county court. Find your local county court.

Do not send your application to the Civil National Business Centre (CNBC) or Traffic Enforcement Centre (TEC).

You will need to pay for your application. The fee is £5. You may be able to get help to pay the fee and other court fees if you have a low income or are on certain benefits.

If you have any questions about the details of your breathing space, you should contact your debt adviser. Do not contact the court.
