Overview

You can no longer apply for a derivative residence card.

If you applied on or before 31 December 2020, your application will still be considered.

If you already have a card, it is no longer valid.

To continue living in the UK, you need another type of permission to stay, such as settled or pre-settled status under the EU Settlement Scheme.

If your card has not yet expired, you can use it as proof of identity when you apply to the EU Settlement Scheme.

If your application is successful, you’ll still need another form of permission to prove your right to live in the UK.

Apply to the EU Settlement Scheme

If you do not have settled or pre-settled status, you might still be able to apply to the EU Settlement Scheme.

The deadline to apply for most people was 30 June 2021. You’ll still be able to apply if you have reasonable grounds for why you could not apply by the deadline. For example, you have a medical condition, or were the victim of domestic violence.

You must also be one of the following:

  • the primary carer of either a British citizen or someone from the EU, Switzerland, Norway, Iceland or Liechtenstein
  • a child of the primary carer of a British citizen or someone from the EU, Switzerland, Norway, Iceland or Liechtenstein
  • a child of someone from the EU, Switzerland, Norway, Iceland or Liechtenstein who used to live and work in the UK - you must be in some form of education to be eligible

Being a ‘primary carer’ means you’re someone’s main carer, or you share the responsibility with someone else at least equally, and you’re their direct relative or legal guardian.

If you cannot apply, check what type of visa you’ll need to come to the UK.
