Consultation on provisional decision on one EA02 merger remedy

3 November 2016: The CMA is consulting on its intention to remove one Enterprise Act 2002 (EA02) merger remedy given before 1 January 2006. The decision document below sets out the CMA’s analysis and provisional decision.

We’re seeking views from interested parties on the provisional decision referred to above. Those responding should provide their views, supported with relevant evidence where possible, in writing to the CMA either by email or by post by 2 December 2016.

3 November 2016: The CMA has decided to remove 7 EA02 merger remedies.

Decision to undertake further review

31 August 2016: The CMA is reviewing 3 further merger undertakings given before 1 January 2006. The decision document below lists the remedies to be reviewed.

We’re seeking views from interested parties as to whether or not there is a case for removing or varying any of these undertakings.

Those responding should provide their views, supported with relevant evidence where possible, in writing to the CMA either by email or by post by 17 November 2016.

Consultation on provisional advice

31 August 2016: The CMA is consulting on its intention to advise the Department for Business, Energy and Industrial Strategy (BEIS) to remove 2 Fair Trading Act 1973 (FTA73) remedies given before 1 January 2006. The decision document below sets out the CMA’s analysis and provisional advice.

It has also concluded that one Fair Trading Act 1973 remedy has lapsed.

Consultation on provisional decisions on 7 EA02 merger remedies

31 August 2016: The CMA is consulting on its intention to remove 7 Enterprise Act 2002 (EA02) remedies given before 1 January 2006. The decision document below sets out the CMA’s analysis and provisional decisions. It has also concluded that one Enterprise Act 2002 remedy has lapsed.

A provisional decision will follow on the remaining Enterprise Act 2002 remedy later in 2016.

Review group appointed

20 June 2016: The CMA has appointed the group for the review of the undertakings.

Simon Polito (Chair), Anne Lambert and Philip Marsden.

Decision to undertake review

14 June 2016: Following an invitation to comment, the CMA is reviewing 12 merger undertakings given before 1 January 2006. The decision document below lists the remedies to be reviewed.

Invitation to comment

22 April 2016: The CMA issued an invitation to comment on proposals to review up to 38 merger remedies put in place before 1 January 2006.

We are continuing to consider the remaining 26 merger remedies, and expect to announce further reviews later this year.
