Final decisions on 3 water merger remedies

6 December 2017: The CMA has published its final decisions under the Enterprise Act 2002 to release the undertakings in 3 water merger remedies given before 1 December 2007. The decision document below sets out the CMA’s analysis and reasoning for these decisions.

Consultation on provisional decisions on 3 water merger remedies

30 October 2017: The CMA is consulting on its intention to remove 3 Enterprise Act 2002 (EA02) water merger remedies given before 1 December 2007. The decision document below sets out the CMA’s analysis and provisional decisions. It has also concluded that 2 EA02 water merger remedies have lapsed.

Inquiry group appointed

26 September 2017: The CMA appointed the inquiry group on 25 September 2017.

Simon Polito (Inquiry Chair), Sarah Chambers and Andrew Popham.

Disclosure of interest

In 2013, Sarah Chambers took part in 2 small consultancy projects as part of a team led by Indepen to advise Northumbrian Water on its business plan, in preparation for its next regulatory review and a similar project for Thames Water. The CMA is satisfied that these matters will not prejudice the ability of the inquiry group to discharge its functions in an independent and impartial manner.

Decision to undertake review

19 September 2017: The CMA plans to review 5 water merger remedies put in place before 1 December 2007. The decision document below lists the remedies to be reviewed.
