TCM1000362 - How to close an appeal

Step 1

On the ‘Function Menu’

  • select ‘Application’ on the toolbar
  • select ‘Maintain Appeal’ from the options available. You will be taken to the ‘Key Entry Data’ screen
  • enter the customer’s NINO
  • select ‘OK’. You will be taken to the ‘Select Award’ screen
  • select the award with an open appeal

Note: This will be the award with an ‘O’ in the ‘Appeals’ column.

  • select ‘OK’. You will be taken to the ‘Maintain Appeal’ screen
  • select ‘Closed’ in the ‘Appeal status’ field
  • select ‘OK’. The appeal is now closed
  • go to Step 2.

Step 2

You will need to check whether the appeal relates to a complex case. For how to do this, use TCM1000024.

If the appeal relates to a complex case, go to Step 3

If the appeal does not relate to a complex case, return to the guidance you were previously following.

Step 3

You will need to check whether some or all of the tax credits debt has been transferred to DWP. For how to do this, use TCM1000633

Note: from September 2017, any customers living in Northern Ireland who have moved to Universal Credit (UC) will have any outstanding debt transferred to the Department for Communities (DfC) for recovery.

If the debt has been transferred to DWP/DfC, go to Step 4

If the debt has not been transferred to DWP/DfC, return to the guidance you were previously following.

Step 4

If the customer lives in Northern Ireland, go to Step 5

If the customer does not live in Northern Ireland, go to Step 6

Step 5

If you are dealing with a closed late appeal where the debt amount has been updated

  • complete a form TC33 and set the UC interest marker against applicants whose debt has been transferred to DfC
  • refer the TC33 to DMB
  • update Household Notes with the message TC14 from TCM01704020. For how to do this, use TCM1000001
  • return to the guidance you were previously following.

If you are dealing with a closed late appeal where the debt amount has not been updated

  • complete the form (This content has been withheld because of exemptions in the Freedom of Information Act 2000) for the applicant whose debt has transferred to DfC.  For how to do this, use TCM1000361
  • refer the form Late Appeal Received / No change – appeal worked to DfC

Note: where your notes indicate both applicants have had their debt transferred to DfC you will need to complete a form Late Appeal Received / No change – appeal worked for each applicant.

  • update Household Notes with the message TC15 from TCM01704020. For how to do this, use TCM1000001
  • return to the guidance you were previously following

Step 6

If you are dealing with a closed late appeal where the debt amount has been updated

  • complete a form TC33 and set the UC interest marker against applicants whose debt has been transferred to DWP
  • refer the TC33 to DMB
  • update Household Notes with the message TC14 from TCM01704020. For how to do this, use TCM1000001
  • return to the guidance you were previously following.

If you are dealing with a closed late appeal where the debt amount has not been updated

  • complete Section 3 of form Late Appeal Received / No Change - Appeal Worked for the applicant whose debt has transferred to DWP.  For how to do this, use TCM1000361
  • refer the form Late Appeal Received / No change – appeal worked to DWP

Note: where your notes indicate both applicants have had their debt transferred to DWP you will need to complete a form Late Appeal Received / No change – appeal worked for each applicant.

  • update Household Notes with the message TC15 from TCM01704020. For how to do this, use TCM1000001
  • return to the guidance you were previously following
