Appeals: Renewals Terminated - appeals identification

Background

Terminated renewal cases are where

  • a reply to the Annual Declaration has not been received by the 1st Specified Date (1SD)

or

  • a reply to an enquiry about the Annual Declaration has not been received by the 1SD, for example, an ‘Incomplete’ work item enquiry

and

  • the case is finalised on the information already held on the computer.

This guidance must be followed to establish if an award has been terminated as a result of renewal processing.

If you establish that the award was terminated as a result of renewal processing, follow the guidance in TCM0264180 to establish if any further action needs to be taken on the case. For example, to restore the award.

Step 1

Check if the ‘Terminated’ signal is set. For how to do this, use TCM1000154.

If the ‘Terminated’ signal is set, go to .

If the ‘Terminated’ signal is not set, go to .

Step 2

Check if the ‘Status’ field shows ‘Terminated Compliance’. For how to do this, use TCM1000403.

Note: The `Status’ field is found on the left hand side of the screen about half way down. It is not the `Status’ column, shown in the Declaration box.

If the ‘Status’ field shows ‘Terminated Compliance’

  • continue with your appeals action as normal. For how to do this, use TCM1000444 
  • take no further action.

If the ‘Status’ field does not show ‘Terminated Compliance’

  • follow the guidance in TCM0264180 
  • take no further action.

Step 3

Check if the ‘Status’ field shows ‘No entitlement’ for the tax year following the award that has been finalised. For how to do this use, TCM1000153.

If the ‘Status’ field shows ‘No entitlement’ for the tax year following the award that has been finalised, continue with your appeals action as normal.

If the ‘Status’ field does not show ‘No entitlement’ for the tax year following the award that has been finalised, go to .

Step 4

Check if any award types are SOA (Statement of Account). For how to do this, use TCM1000042.

If one or more of the award types are SOA for the claim you are working, go back to .

If no award types are SOA, continue with your appeals action as normal.
