Apply for legal aid for civil contempt cases

The Legal Aid Agency (LAA) has published guidance on the funding of civil contempt cases.

How to apply

Civil contempt proceedings are criminal for the purposes of legal aid as there is a risk that the client may go to prison.

Remuneration for such proceedings will be paid at the rates set out in the Criminal Legal Aid (Remuneration) Regulations 2013.

The Legal Aid Agency (LAA) has issued Apply for legal aid in civil contempt cases guidance (PDF, 451KB, 9 pages) for providers on the legal aid application process for these cases as well as how to make a claim.

Applications for legal aid in these proceedings should be made on the CRM14 paper application.

Claims for payment for civil contempt work should be made on the CRMCLAIM11 form (PDF, 121KB, 2 pages) .

Claims for payment of assigned counsel in these cases should be made on the CRM8 form.

Representation for breach of an injunction under part 1 Anti-Social Behaviours Crime and Policing Act (ASBCPA) 2014

The process for applying for representation in proceedings concerning breach of an injunction under part 1 ASBCPA 2014 is the same as set out in the civil contempt guidance. The ASBCPA 2014 guidance (PDF, 442KB, 10 pages) sets out how to complete the application form.
