Undertaking given by Training Qualifications UK (TQUK) to Ofqual in accordance with Condition B8 of the General Conditions of Recognition (“Conditions”)

1. Background

In the context of:

(a) Event Notifications submitted by TQUK in respect of occurrences relating to the provision of TQUK’s Functional Skills Qualifications in Mathematics and English on the following dates:

• Event Notification - 3 September 2025

• Event Notification - 23 September 2025

• Event Notification - 24 September 2025

• Event Notification - 23 October 2025

• Event Notification - 12 February 2026

(b) Ofqual’s letter of allegations dated 31 March 2026, setting out why it considered TQUK had breached Condition B3.1 in respect of each of the notifications.

TQUK admits to having breached that condition, as alleged.

2. Undertaking

1. 2.1 Pursuant to General Condition B8, Ofqual may accept a written undertaking from an awarding organisation that it will take specified steps to secure compliance with the Conditions.

2. 2.2 For the purpose of securing such compliance, TQUK undertakes to implement the actions set out in Schedule 1 (the action plan) within the timeframes set out therein.

3. 2.3 The objective of this undertaking is that TQUK will have in place systems and processes which ensure the timely submission of Event Notifications for all regulated qualifications.

4. 2.4 TQUK shall review the implementation of the action plan and on or before 30 November 2026 will submit to Ofqual a report setting out its evaluation of the effectiveness of the actions set out in the action plan.

5. 2.5 That report shall be accompanied by either:

   1. (a) a Statement of Assurance signed by the Responsible Officer confirming the objectives of the undertaking have been achieved; or

   2. (b) if the Responsible Officer is unable to provide such assurance, an explanation of the reasons for that position, along with its proposals to secure compliance forthwith.

TQUK

3. Acknowledgement

In giving this undertaking, I acknowledge on behalf of TQUK that:

(a) the rules of interpretation and definitions outlined in General Condition J1 shall apply to this undertaking;

(b) Ofqual may publish this undertaking on its website (it being accepted however that Ofqual will not publish Schedule 1);

(c) Ofqual may provide information to the Department for Education about TQUK’s undertaking, including TQUK’s performance under the undertaking and the sharing of any updates provided by TQUK;

(d) Ofqual may take regulatory action in respect of any failure to comply with the terms of this undertaking or in the event the undertaking proves ineffective in relation to its objectives. Such action may include the issue of a direction, the imposition of a monetary penalty, withdrawal of Recognition, costs recovery and/or any other such action as it deems appropriate, acting in accordance with Ofqual’s “Supporting Compliance and Taking Regulatory Action” policy;

(e) nothing within this undertaking restricts Ofqual’s ability to conduct its own review, audit, investigation and/or other monitoring activity of TQUK at any time; and

(f) this undertaking will remain in force until Ofqual confirms that it is satisfied that the actions set out in Schedule 1 have been performed and that it may be discharged.

4. Variation

TQUK and Ofqual may from time to time vary this undertaking by mutual agreement.

5. General

Nothing in this undertaking shall require TQUK to publish or otherwise disclose any confidential information, other than to Ofqual.

6. Effective date of this undertaking

This undertaking takes effect on 1 September 2026.
