Purpose

  1. The purpose of this circular is to inform you that the above regulations will come into force on 1 December 2008 and to explain their effect.

Background

  1. The Taylor Review of the police officer disciplinary arrangements was published in 2005 and recommended a new disciplinary procedure and a review of the unsatisfactory performance procedures for police officers.

  2. A working party of the Police Advisory Board for England and Wales together with the Independent Police Complaints Commission and the Home Office has worked to produce the detailed arrangements set out in these regulations.

The Police (Performance) Regulations 2008

  1. The Police (Performance) Regulations 2008 replace the Police (Efficiency) Regulations 1999 (SI 1999 No.732) and set out the procedures for dealing with cases of unsatisfactory performance or attendance of police officers. The regulations apply to all police officers (including special constables) up to and including the rank of chief superintendent.

The Police (Conduct) Regulations 2008

  1. The Police (Conduct) Regulations 2008 replace the Police (Conduct) Regulations 2004 (SI 2004 No.645) and set out the procedures for dealing with cases of misconduct or gross misconduct. The regulations apply to all police officers (including special constables) of any rank.

The Conduct Regulations contain the new Standards of Professional Behaviour which set out the standards of behaviour that police officers are expected to maintain. These standards should be actively promoted to all staff.

The Police (complaints and misconduct) (amendment) Regulations 2008

  1. The Police (Complaints and Misconduct) (Amendment) Regulations 2008 amend the Police (Complaints and Misconduct) Regulations 2004 (SI 2004/643) and will provide the link between the new misconduct procedures for police officers of all ranks and special constables, to the police complaints system that is governed by the provisions in Schedule 3 of the Police Reform Act 2002.

The Police Appeals Tribunals Rules 2008

  1. The Police Appeals Tribunals Rules 2008 replace the Police Appeals Tribunals Rules 1999 (SI 1999 No.818) and set out the procedures for an appeal to a Police Appeals Tribunal and the grounds on which a police officer and special constables can appeal against a finding and/or a particular outcome from the Conduct and Performance regulations.

The Police Amendment Regulations 2008

  1. The Police Amendment Regulations 2008 amend the Police Regulations 2003 (SI 2003 No.527) and update the disciplinary and unsatisfactory performance outcomes that are required to be recorded on a police officer’s personal record and the time that such outcomes will remain on that record.

Transitional provisions

  1. The Police (Conduct) Regulations 2008 will apply where an allegation in respect of a police officer comes to the attention of the appropriate authority on or after 1 December 2008.

  2. The Police (Performance) Regulations 2008 will apply where unsatisfactory performance or attendance by a police officer comes to the attention of the line manager on or after 1 December 2008.

11.  Where a complaint is received by the Independent Police Complaints Commission prior to 1 December 2008 and is forwarded to the appropriate authority who receive the complaint after the 1 December 2008 then the matter will fall to be dealt with under the Police Reform Act 2002 (as amended by the Criminal Justice and Immigration Act 2008) and the Police (Complaints and Misconduct) Regulations 2004 (as amended by the Police (Complaints and Misconduct) (Amendment) Regulations 2008).
