Environmental Permitting (England and Wales) Regulations 2010

United Utilities Water Limited (reference 317)

The offence was failure to comply with a permit condition (water discharge activity) - Regulation 38(2).

This was a reactive offer. The actions the offeror has taken or will take are to:

  • do site improvement and infrastructure works
  • remediate and restore the site
  • revise their maintenance programme
  • review their procedures
  • do an environmental study
  • benefit the impacted third party
  • cover the Environment Agency’s costs

They will contribute £208,650 to:

  • Mersey Rivers Trust - £150,000
  • Community Forest Trust - £25,000
  • Lancashire Wildlife Trust - £33,650

This was a reactive offer. The actions the offeror has taken or will take are to:

  • remediate and restore the site

  • cover the Environment Agency’s costs

They will contribute £232,000 to:

  • Community Forest Trust - £142,000
  • Mersey Rivers Trust - £90,000

This was a reactive offer. The actions the offeror has taken or will take are to:

  • do site repairs
  • do improvement and infrastructure works
  • do training and awareness sessions
  • remediate and restore the site
  • cover the Environment Agency’s costs

They will contribute £200,000 to Yorkshire Wildlife Trust.

Carlsberg Supply Company UK Limited (reference 510)

The offence was operating without or other than in accordance with a permit (water discharge activity) - Regulation 38(1).

This was a reactive offer. The actions the offeror has taken or will take are to:

  • revise procedures
  • do site improvement and infrastructure works
  • put a new or revised inspection programme in place
  • do site surveys and assessments
  • cover the Environment Agency’s costs

They will contribute £120,000 to:

  • The Wildlife Trust for Bedfordshire, Cambridgeshire and Northamptonshire - £80,000
  • River Nene Regional Park Community Interest Company - £40,000

They will contribute £975,000 to:

  • Dorset Waste Partnership - £400,000
  • Dorset Litter Free Coast and Sea Project - £100,000

  • Durham Wildlife Trust - £45,000
  • Wear Rivers Trust - £45,000
  • Marine Conservation Society - £45,000

This was a reactive offer. The actions the offeror has taken or will take are to:

  • do site improvement and infrastructure works

Northumbrian Water Limited (reference 524)

The offence was operating without or other than in accordance with a permit (water discharge activity) - Regulation 38(1).

The offences were failure to register 40(1)(a) and failure to take reasonable steps to recover and recycle packaging waste 40(1)(b).

This was a reactive offer. The actions the offeror has taken or will take are to:

  • register with a compliance scheme
  • assign a ‘responsible person(s)’
  • implement new methodology and internal processes
  • cover the Environment Agency’s costs

They will contribute £24,329.54 to Marine Conservation Society.
