Separation Agreement Joint Committee decision 2/2020: social security coordination between the UK, EU and EFTA states

Decision No 02/2020 of the Joint Committee established by the Separation Agreement of 18 December 2020 setting the date from which the provisions of Title III of Part Two of the Agreement shall apply to European Union citizens.

The Joint Committee,

Having regard to the Separation Agreement, and in particular Article 32(2) thereof, Whereas:

(1) Pursuant to Article 32(1) of the Separation Agreement [footnote 1], the provisions of Title III of Part Two of the Agreement on the coordination of the social security systems, applicable to nationals of Iceland, the Principality of Liechtenstein, and the Kingdom of Norway, shall apply to European Union citizens provided that the European Union has concluded and applies corresponding agreements, on the one hand, with the United Kingdom which apply to EEA EFTA nationals, and, on the other hand, with the EEA EFTA States which apply to United Kingdom nationals.

(2) Pursuant to Article 32(2) of the Separation Agreement, upon notification from the United Kingdom and from the EEA EFTA States of the date of entry into force of these agreements, the Joint Committee shall set the date from which the provisions of Title III of Part Two of the Agreement shall apply to Union citizens.

(3) The EEA EFTA States have concluded a corresponding agreement with the European Union [footnote 2] which applies to United Kingdom nationals. The United Kingdom has concluded a corresponding agreement with the European Union [footnote 3] which applies to nationals of Iceland, the Principality of Liechtenstein and the Kingdom of Norway.

(4) In view of the notifications from the United Kingdom and from the EEA EFTA States of the date of entry into force of the agreements referred to in recital (3), the date from which the provisions of Title III of Part Two of the Separation Agreement shall apply to Union citizens should be 1 January 2021.

Has adopted this decision:

Article 1

The date from which the provisions of Title III of Part Two of the Separation Agreement shall apply to European Union citizens shall be 1 January 2021.

Article 2

This Decision shall enter into force on the day of its adoption.
