This guidance is designed to be used alongside Appendix Scale-up of the Immigration Rules. The rules explain the requirements an applicant must meet, and this guidance provides additional information on how to consider their application. Paragraph references refer to Appendix Scale-up unless otherwise stated.

  1. This guidance has been updated to reflect changes to the Immigration Rules coming into force on 4 April 2024, as set out in Statement of Changes HC 590, and updates salary thresholds and going rates.

  2. Updated with a requirement that applicants must genuinely intend to undertake their sponsored job. These changes apply to applications made from 7 August 2023.

  3. Validity requirements updated to explain the requirements for applicants who are switching from student permission on or after 17 July 2023.

  4. The guidance has been updated to reflect the 12 April Immigration Rules changes, including updates to salary thresholds, the minimum hourly rate and the hours used to calculate going rates for individual occupations, and clarification of how salaries are considered where an applicant is working a pattern where the regular hours are not the same each week.

  5. Latest version of the guidance, including removal of the police registration condition and updated links to Appendix Scale-up.
