Privacy notice: national operator waste returns

As part of ensuring compliance with an environmental permit the Environment Agency collects information submitted on:

  • waste accepted and removed from permitted waste sites, including materials facilities
  • details of technically competent managers (TCMs)

We are the data controller for this information. A data controller determines how and why personal data (personal information) is processed.

1. The data we need

The personal data we collect includes:

  • names, dates of birth (to confirm the TCM’s identity), addresses, emails and contact details if you are an individual, director or company secretary of a company, person responsible for supplying environmental information or a TCM
  • names, addresses, emails and contact details if you are the agent, the consultant, the employee responsible for the operation of the activity or the employee responsible for providing environmental monitoring information
  • questions, queries or feedback you leave, including your email address if you contact us

We are allowed to process your data because we have official authority as the environmental regulator. The lawful basis for processing this data is to perform a task in the public interest that is set out in law.

We need the information we request to ensure you are complying with your environmental permit. We may process your information during any potential enforcement action.

2. Your responsibility with others’ personal data

If you have included personal data about any other individuals on your submission, you must tell them. You must provide them with a copy of this privacy notice so that they are aware of how their personal data will be used.

3. What we do with the data

We use the information to ensure you comply with the conditions of your environmental permit.

We put the information on a public register. Public register information can be inspected and copies obtained at our offices. Also copies can be sent out on request including to requesters outside the European Economic Area. See how to access the public register for environmental information.

We may use your email address data to contact you about the information you have submitted, our service or legislative changes that directly affect the regulation of your permit.

We will not share your details with any other third party without your explicit consent unless required to by law.

We store and process your personal data on our servers in the UK.

We do not use your data to make an automated decision or for automated profiling.

4. How long we hold personal data

We keep your personal data while the permit is in use and for 6 years after the permit has been surrendered. If the permit is for a landfill site, we keep the data for 10 years after surrender. We then remove it from the public register.
