Permits for schedule 25B, tranche B specified generators: RPS 219

This Regulatory Position Statement has expired.

Under the Environmental Permitting (England and Wales) Regulations 2016, operators of schedule 25B, specified generators with one or more tranche B generators must have a permit from the Environment Agency by 1 January 2019.

However, the Environment Agency:

  • recognises that some operators will not have been able to submit their permit applications in time to receive a permit by 1 January 2019
  • has received many permit applications that need bespoke determination – this will take longer than planned so we’ve extended the date that you need a permit to 31 August 2019

They will not take enforcement action against you providing you meet the conditions in this regulatory position statement (RPS).

Conditions you must comply with

You must have submitted your ‘duly made’ permit application to the Environment Agency by 1 January 2019.

You must have included evidence that you:

  • can meet the standard emission limit value (ELV) for nitrogen oxides
  • comply with the environmental quality standards for air

If secondary abatement is required your generator must meet the ELV from 1 January 2019.

You must make sure your activities do not endanger human health or the environment. You must not:

  • cause a risk to local air quality
  • adversely affect the countryside or places of special interest

Enforcement

An RPS means that the Environment Agency will not normally take enforcement action against you provided:

  • your activity meets the description set out in this RPS
  • you comply with the conditions set out in this RPS
  • your activity does not, and is not likely to, cause environmental pollution or harm human health

Permit deadline

Providing you submitted your duly made permit application by 1 January 2019, the Environment Agency will determine and issue your permit by 31 August 2019.
