The Charity made an application for a certificate of incorporation for the trustee body under Part XII of the Charities Act 2011. This application was declined.

The review was conducted by a Senior Casework Manager in the Commission’s First Contact team. In making his decision he reviewed all of the Commission’s papers relating to the matter including the most recent information provided by the charity. He considered the Commission’s application of its Policy, set out in Operational Guidance 50, to the information presented by the charity. When declining the application the Commission previously questioned whether there was an alternative approach to helping the charity achieve its desired outcome, in order to satisfy itself that the charity has considered other options. On reading the papers relevant to this matter, it was clear to the reviewer that the charity had considered other options and having done so, wished to continue with its application to incorporate the trustee body. Therefore the reviewer decided that the certificate should be granted.
