OPSS enforcement actions 1 October 2024 to 31 March 2025

The Office for Product Safety and Standards (OPSS), the UK’s product regulator is part of the Department for Business and Trade, and exercises the powers of the Secretary of State in relation to a range of regulations. Our approach to addressing non-compliance by those we regulate, and potential product safety risks, is set out in our Enforcement Policy. This also sets out the approach we take to publishing details of enforcement actions.

The enforcement actions listed below were taken by OPSS from 1 October 2024 onwards. Further enforcement actions will be added periodically. Actions are grouped under the following headings: Construction Products, Environmental Protection and Product Safety.

Construction Products – October 2024

Business: SUPER TOUGHENED GLASS LTD

Action taken:

Prohibition Notice dated 24 October 2024, served with effect from 4 November 2024 under Regulation 11(1) of the Construction Products Regulations 2013, as applicable in England, Wales and Scotland.

Products:

Any products placed on the market as heat-soaked thermally toughened soda lime silicate safety glass irrespective of size, thickness and shape, for use in buildings, that cannot be determined to meet the specifications of designated standard BS EN 14179-2, manufactured on-site by Super Toughened Glass Ltd trading as Super Tuff at Glass House Unit 2, 5-9 Willenfield Road, Park Royal, London NW10 7BQ.

Breached regulation details:

Regulation 4(1)(a) of the Construction Products Regulations 2013.

Detail:

The Notice prohibits the supply of the above products, as upon request by OPSS, the manufacturer was unable to provide a declaration of performance.

The manufacturer subsequently provided the required documentation. The Prohibition Notice was revoked on 13 January 2025.

Environmental Protection - October 2024

Business: CVS Energy Ltd t/a Clearview Stoves

Action taken:

Stop Notice dated 21 October 2024, served under Regulation 13(b) and Schedule 5, para 13(1)(a) of the Ecodesign for Energy-Related Products Regulations 2010.

Products:

  • Pioneer 400 Stove
  • Pioneer 400P Stove
  • Solution 400 Stove
  • Vision Inset Deep Stove
  • Pioneer Oven Stove with Oven & Hotplate
  • Vision 500 Stove with Hotplate
  • Solution 500 Stove
  • Solution 500SB Stove with integrated Boiler
  • Clearview 650 Stove with Hotplate
  • Clearview 750 Stove with Hotplate

Breached regulation details:

Regulation 14(1) of the Ecodesign for Energy-Related Products Regulations 2010.

Detail:

The manufacturer failed to make all relevant technical information and documentation including Declarations of Conformity for the above products, available for inspection by OPSS.

Furthermore, the manufacturer failed to take action or respond to the previously served Compliance Notices (dated 21 August 2024). Manufacturer prohibited from placing listed products on to the market until a completion certificate is issued by OPSS.

Business: CVS Energy Ltd t/a Clearview Stoves

Action taken:

Stop Notice dated 21 October 2024, served under Regulation 6(d) and Schedule 4, para 13(1)(a) of the Energy Information Regulations 2011.

Regulation 11(1)(b) of the Energy Information Regulations 2011.

Detail:

The manufacturer failed to make all relevant technical information and documentation including Declarations of Conformity for the above products, available for inspection by OPSS.

Product Safety – November 2024 

Business: SUZHOUYUEZHIFUKEJI CO., LTD t/a Joyful Inspiration (online seller, based in China) 

Action taken: 

Recall Notice dated 21 November 2024, served under Regulation 15(1) of the General Product Safety Regulations 2005, by virtue of Regulation 53(2)(d) of the Toy (Safety) Regulations 2011. 

Product: 

5 packs, hot selling water balloon reusable water balloon silicone water polo toy decompression silicone toy water balloon 

Detail: 

The product presents a serious risk of choking and injuries due to the presence of small parts. Some parts also have a magnetic flux over the allowable limit. Small, high-powered magnetic products can be easily swallowed and, when ingested, have the potential to cause serious internal injuries within the gastrointestinal tract. 

The online seller is required to recall the product from end users. The online marketplace (Temu) removed the product listing.

Product Safety – December 2024 

Business: Dongguan City Ke Ang Rubber Products Limited Company (online seller, based in China) 

Action taken: 

Withdrawal Notice dated 5 December 2024, served under Regulation 14(1) of the General Product Safety Regulations 2005, by virtue of Regulation 53(2)(c) of the Toy (Safety) Regulations 2011. 

Product: 

8/12PCS Reusable Water Balls Quick Fill Silicone Water Balloons Soft Bombs Water Fight Supplies Mixe 

Detail:  

The product presents a risk of harm to human health due to the absence of the required labelling and hazard warnings. 

The online seller is required to recall the product from end users. The online marketplace (Light in the Box) removed the product listing.
