To clarify the rules on importing any animal feed containing former foodstuffs. 

Background 

Products of animal origin (POAO), or foodstuffs containing POAO, which are no longer intended for human consumption for commercial reasons, or due to problems of manufacturing or packaging defects, or other defects from which no risk to public or animal health arise, are deemed to be Category 3 Animal by-products and derived products not intended for human consumption (ABP) (‘former foodstuffs’).  

The change, from POAO (for human consumption) to ABP, occurs when the decision is taken that they are no longer intended to be used for human consumption.   

Any animal feed containing ‘former foodstuffs’ must be imported as ABP/derived products, with labelling and import documentation in accordance with the ABP regulations. BTOM risk categories for ABP/derived products will also apply. 

We are aware that some traders are importing animal feed containing ‘former foodstuffs’ using POAO documentation and applying POAO Border Target Operating Model (BTOM) risk categories. These consignments are, therefore, not compliant with ABP regulations.  

These consignments cannot be imported using any POAO documentation or applying POAO BTOM risk categorisation as they are clearly not intended for human consumption. Risk categories, import conditions (including labelling requirements) and documentation for POAO (for human consumption) cannot be applied to these products.
