Purpose
To ensure the consistent application of 853/2004 in regards of frogs’ legs and snails and avoid illegal entry at BCP’s. We need a consistent approach at the ports in the application of the import controls to help avoid any confusion for importers.
Background
We have been made aware of inconsistencies with the controls undertaken at some BCP’s, which have led to unauthorised products being admitted inland. Annex I of assimilated Regulation 853/2004 defines frog’s legs and snails as:

‘Frogs’ legs’ of the species RNA (family Ranidae).

‘Snails’ of the species Helix pomatiaLinné, Helix aspersaMuller, Helix lucorum and species of the family Achatinidae.
Actions for OVSs
If snails or frogs’ legs are not from the family or species above, they would fall outside of the scope of the legislation and are therefore not permitted.
