NTE 2025/13: the export control (amendment) regulations 2025

Introduction
Further to Notice to exporters 2025/06 giving advanced notice of updates to the UK strategic export control list.
The Export Control (Amendment) Regulations 2025 (the Regulations) amend the Export Control Order 2008 (“the 2008 Order”) and assimilated Council Regulation (EC) No 428/2009 of 5 May 2009 setting up a Community regime for the control of exports, transfer, brokering and transit of dual-use items (Recast) (“the assimilated Dual-Use Regulation).
The Regulations will come into force on 20 May 2025.

These Regulations make changes to:
- the fines which may be imposed for certain offences set out in Part 6 of the 2008 Order
- Schedule 2 (military goods, software and technology) to the 2008 Order
- Schedule 3 (dual-use goods, software and technology) to the 2008 Order
- Annex I (dual-use goods, software and technology) to the assimilated Dual-Use Regulation
Amendments to the 2008 Order
The amendments to the 2008 order:

increase the maximum level of fine that may be imposed under the 2008 Order for certain offences on summary conviction, from level 3 on the standard scale (£1,000) to level 4 (£2,500)

update Schedule 2 (which lists military goods, software and technology) to reflect routine technical updates to controls on the exports of conventional weapons agreed through the multilateral export control regime known as the Wassenaar Arrangement - these include deletion or replacement of some definitions and editorial amendments related to ML1, ML2, ML7, ML10, ML13, ML19 and ML21 and associated Technical Notes.

make administrative amendments to the technical parameters of the control entry PL9013.a.4 in Schedule 3, which the UK implemented in April 2024
Amendments to the assimilated Dual-Use Regulation
The amendments to the assimilated Dual-Use Regulation update Annex I (which lists dual-use goods, software and technology) to reflect routine technical updates to the Wassenaar Arrangement dual-use list as well as the control lists administered by other multilateral export control regimes such as Australia Group, Nuclear Suppliers Group and Missile Technology Control Regime.
These include the deletion or replacement of numerous definitions and editorial amendments to several control entries including:
