Details

The booklet and leaflet are provided for police officers to use if they wish, to help detainees and, if applicable, appropriate adults, to recognise and understand the rights and entitlements set out in the Notice of Rights and Entitlements which must be given to each detainee and their appropriate adult.

In deciding whether and how to use the booklet and leaflet, it is important to note that they do not include everything in the Notice and therefore cannot be used as an alternative to the Notice or to the separate requirement in paragraph 3.1 of PACE Code C that detainees are told clearly about their continuing rights, the offence for which they have been arrested and why they have been arrested and detained.

For example, the leaflet for under 18s does not include the complete requirement in paragraph 3.1 and does not mention the caution or the right to remain silent. It does however contain other information which is not included in the Notice.
