Non-land measures administered by trader operations privacy notice

The measures included in this privacy notice consist of Rural Payments Agency (RPA) services relating to imports, exports, food producer organisations, and interventions.

1. Purpose for Processing

These measures consist of the following services.

1.1 Import and Export Licensing Scheme (including Tariff Rate Quotas)

The system for managing import and export licences regarding the rules on the release and forfeit of securities lodged for such licences.

1.2 Hops Exports Attestations

RPA is the competent authority to issue Hops Attestation of Equivalence in Great Britain to enable the exportation of hops and hops products to the European Union (EU).

1.3 Wine VI1 Certificates

RPA is the competent authority to issue Wine VI1 certificates for the re-export of imported wine to the EU.

1.4 Dairy Producer Organisations

An organisation formed on the initiative of a group of farmers, which has one or more aims. This includes negotiating contracts for the delivery of raw milk on behalf of its members.

1.5 Fruit and Vegetable Producer Organisations

Aid to help growers increase their competitiveness in the supply chain.

1.6 Private Storage (Dairy, Skimmed Milk Powder and Pigmeat)

These schemes are market support measures that help to stabilise the prices of certain products.

1.7 Public Intervention (Butter, Cereal, Dairy and Skimmed Milk Powder)

Intervention schemes are market support measures that help to stabilise the prices of certain products.

1.8 School Milk Scheme

Aid for the supply of milk in educational establishments

2. Why we are able to process your personal data

The law allows us to process your personal data under article 6(1)(e) of the UK General Data Protection Regulation (UK GDPR). We are allowed to process personal data when we need to carry out a public task.

The relevant law for each of these services is:

  • Private Storage (Dairy, Skimmed Milk Powder and Pigmeat) - Assimilated Regulations 1308/2013, 2016/1238, 2016/1240, SI 2019/748, 2019/765, 2019/831, 2019/1402 and 2020/1445

  • Public Intervention (Butter, Cereal, Dairy and Skimmed Milk Powder) - revoked by SI 2023/124 in England – R1308/2013, 2016/1238, 2016/1240, 1370/2013, 906/2014, 907/2014, 908/2014. SI 2019/748, 2019/765, 2019/831, 2019/1402, 2020/1445

  • Crisis Measures Public Intervention - Assimilated Regulation 1308/2013 Articles 219 – 222

  • School Milk Scheme - Assimilated Regulations 1308/2013, 2017/39 and 2017/40

We have a legal obligation to provide beneficiary data to Defra, who publish it to meet EU retained legislation, aimed at promoting transparency.

3. What personal data we process

The information that we collect and process is:

  • customer registration information
  • eligibility, applications, grants and details of payments
  • an evaluation of the strengths of your application against the scheme priorities
  • consideration of the overall effectiveness of the scheme or function and whether the outcomes met the aims
  • lessons learnt
  • information in relation to the development of policies and new schemes
  • details of anyone who acts for you, for example an agent

We may process your personal data including your email address in any questions or feedback you send to us. We may also use your information to contact you about future grants and updates to farming policy that would be relevant to you.

4. Your responsibility with other people’s personal data

If you’ve included personal data about other people in your records, you must tell them. You must provide them with a copy of this privacy notice so that they know how their personal data will be used.

5. Where your personal data is stored

We store, transfer and process your personal data on our servers in the United Kingdom (UK) and the European Union (EU).

6. How long we keep your personal data

We keep your information for 7 years.

We share your personal data with:

  • Competition and Markets Authority
  • Department for Environment, Food & Rural Affairs
  • Food Standards Agency
  • Animal and Plant Health Agency
  • HM Revenue and Customs
  • Scottish Government Rural Payments and Inspections Directorate
  • Welsh Government Rural Payments Wales
  • Department of Agriculture, Environment and Rural Affairs Northern Ireland
