It is important for patients to understand their NHS Constitution right to start treatment within maximum waiting times. It is the responsibility of commissioners and providers to publicise patient rights and the options available to local people where treatment within 18 weeks is at risk.

David Flory, Deputy NHS Chief Executive, wrote to the NHS in February to reiterate expected performance and good practice on referral to treatment waiting times in 2012/13, including the responsibility to publicise the NHS Constitution patient right to access consultant led non urgent treatment within a maximum of 18 weeks.
