What personal data’s collected and how it’s used
To undertake its duty to secure a route around the whole of the English coast and associated margin, Natural England uses information in:
- King Charles III England Coast Path (KCIIIECP) representations and objection forms
- any supporting material
- general correspondence relating to the planning, establishment and management of the KCIIIECP
This includes:
- discussing correspondence, objections and representations with you and other agencies and using it to inform Natural England’s proposals to the Secretary of State for Environment, Food and Rural Affairs
- processing formal objections and representations in line with regulations
- ongoing management and maintenance of the route and the coastal margin
The personal information Natural England processes includes:
- your name and contact details (including address, e-mail and / or telephone number)
- reason for contacting Natural England
- details of any correspondence and outcomes of any meetings relating to the planning and establishment of the KCIIIECP
- objections and representations
The legal basis for processing your personal data
Part 9 of the Marine and Coastal Access Act 2009 placed a statutory duty on Natural England to secure a route around the whole of the English coast and associated margin. Section 298 of the Act obliges Natural England to act in accordance with its coastal access scheme which states it must:
- take all reasonable steps to identify owners and occupiers whose land may be affected by the KCIIIECP’s route
- notify those with a relevant interest in affected land and those specified in legislation of the publication of its coastal access reports to the Secretary of State
Consent to process your data
The processing of your data is not based on consent. You cannot withdraw it.
Who Natural England shares your personal data with
Natural England shares your personal data, comments, representations and objections relating to its KCIIIECP report proposals with Defra and the Planning Inspectorate. Natural England may also share the data:
- with the relevant local authority and the Environment Agency
- at a later public inquiry or hearing
Natural England respects your personal privacy when responding to access to information requests. Natural England only shares information when necessary to meet the statutory requirements of the Environmental Information Regulations 2004 and the Freedom of Information Act 2000.
How long Natural England holds personal data
Natural England will review any personal data it holds after 10 years from commencement of coastal access rights on the specific stretch you are affected by, to determine if the information is still relevant in terms of ongoing management of the KCIIIECP and the coastal margin. If Natural England feels that it’s no longer relevant, it will destroy it.
If we are made aware that the details have changed before then, we will of course update the information we hold.
What happens if you do not provide the data
Natural England cannot act upon objections or representations that do not include name and contact details.
Use of automated decision-making or profiling
The information you provide is not used for:
- automated decision making (making a decision by automated means without any human involvement)
- profiling (automated processing of personal data to evaluate certain things about an individual)
Transfer of data outside the European Economic Area (EEA)
Natural England will not transfer your data outside the EEA.
