September 2017 update: Further to the October 2015 update, Infrastructure and Projects Authority (IPA) reports from June 2011 were published on 15 October 2015. The government has now published IPA’s reports on HS2 from September 2013 to September 2015. This decision was reached following a subsequent information request and the First-tier Tribunal’s judgment in the Ewin/Rukin case. The government decision was reached taking into account the both the age and specific content of the reports.

June 2015 update: In March 2015 the Supreme Court handed down its judgement in the Evans case, which limited considerably the circumstances in which the FOI veto can be exercised. The government had previously used the veto to withhold a MPA report on the HS2 project. That decision was judicially reviewed. The government is withdrawing from the judicial review proceedings. It is releasing MPA project assessment review reports from 2011 and 2012.

October 2015 update: Further to the June 2015 update, MPA reports from November 2011 and June 2012 were published on 25 June 2015. The government has now also decided to publish the June 2011 MPA report on HS2. This decision was reached following a subsequent information request and taking account of both the age and specific content of the report.

MPA reports are written so that those working on the project and those responsible for its governance and oversight, can:

  • address recommendations
  • reassess risks
  • revise plans

to deliver objectives efficiently and meet required standards in the public interest. For the reports to meet this aim, they are written on the understanding of there being a ‘safe space’ for officials to give candid advice to ministers on policy and implementation issues. This space also gives project teams time ‘to get on and do’. The government believes in the need to safeguard the safe space. We will continue to consider other requests for MPA reports on this basis.
