The Issue before the Charity Commission was whether to give consent to a change in objects for the Golden Giving Charitable Trust.

The charity wished to change its objects from:

to promote the conservation and improvement of the natural environment of the Aldbury Village and surrounding area.

to:

to benefit any charitable institution, to use its funds for any charitable purposes anywhere in the world.

The Commission decided not to give consent on the basis that the proposed amendment represents such a radical change that it would not be within the reasonable contemplation of those who have supported the charity.

The effect of the proposed amendment would be to create a new charity.

We have suggested instead that if the applicant wishes to establish a charity with the proposed objects, the best way forward would be to make a fresh application to register and the matter would be given consideration by the Registration Division.
