Financial condition supporter: privacy information notice

The Home Office is the controller for this information. This includes when the information is collected or processed by third parties on our behalf.

Introduction

Immigration Enforcement hold and process your personal information supplied or collected for the purposes of applying the financial condition supporter policy and process for all proposed financial supporters as part of the immigration bail process and rely on the following Home Office privacy information notice (PIN)

However, we have also developed a bespoke PIN to support our processes for financial condition supporters and to support and advise all proposed and authorised financial condition supporters of your data protection rights.

You should ensure that you read this in conjunction with bail pack given to the bail applicant who has proposed you as their financial condition supporter.

Legislative powers

The legal basis for the processing of your data is Article 6(1)(e) of the (UK GDPR) – that is, that the processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

We will process special categories of personal data on the basis of Article 9(2)(g) of the UK GDPR where the processing is necessary for reasons of substantial public interest. This is inclusive of nationality information.

What data will we process

We will conduct various security checks against Home Office database systems and other databases using your name , dob and nationality.

We will seek to collect any criminal convictions you may have via the Police National Computer (PNC).

We will conduct credit checks with credit reference agencies.

We will conduct banking checks to ensure you have the financial capability to pay any liability payment you have proposed as a financial condition supporter.

A no time is personal data subject to automated decision making without human intervention or used to profile data subjects.

Sharing data with third parties

In certain circumstances, where we have exhausted all avenues for liability collection, we may pass on your details (name, address and date of birth) to a third party debt collection agency.

You will be advised of this prior to implementation in writing by post .

How data is stored

The data is stored on our Home Office database internal immigration and caseworking database.

How long data will be stored

Your data will be stored for as long as you are a financial condition supporter for a person on immigration bail and for 6 years after that immigration bail is ceased.

How to get a copy of your personal information.

You have the right to ask for a copy of your personal information.

Under the UK GDPR you also have the right to object to and ask to restrict our use of your personal information, and to ask us to rectify or delete your personal information. However, there may be a number of legal or other official reasons why we need to continue to keep or use your data.
